Your listing, while being a bannable offence, is also a criminal offence. It's not actually legal to make copies of works for your own use, let alone trying to sell them (i know thius is a ridiculous situation, but legally, you can't even rip your CDs that you have legally purchased to MP3 for your portable player).
If FACT (federation against copyright theft) had been alerted, you could be facing charges. Not something you want really. I would seriously recommend not trying this sort of thing again. (And yes there are multiples of MP3 DVDs/ CDs on ebay, ebay can't be bothered unless they are reported to them, in which case they might get off their fat greedy profit-making backsides to do something about it. If they can be arsed).0 -

Luckily I've never been banned from eBay, but I did have a listing removed for a brand-name item of questionable authenticity (I bought it in a charity shop and couldn't say for sure whether it was genuine), and I asked why my listing in particular had been removed when many other similar listings weren't, and was told that they don't actively monitor listings for breaches, but investigate those which are reported.
I'm now a bit wary about selling more secondhand posh brand name items, e.g. I bought a Versace Intensive bag at a jumble sale yesterday, which I think is probably real because it has "Versace" on the zip pull, but I'm not sure about listing it in case it's not.
One could almost be forgiven for thinking that copied MP3 compilations are allowed since so many go unchallenged, but selling pirate copies of any description can get you into trouble, even though some customers (one of whom posted here) genuinely just want MP3 copies of albums they already own, e.g. on vinyl.
I came across one (presumably) MP3 pirate compilation of a "collection" of albums (listed as "new" but with a price and p&p way too low for originals), whose seller avoided using keywords which potential informers might search for by simply stating "IF YOU DON'T NO (sic) WHY IT'S SO CHEAP THEN PLEASE DON'T BID"!0 -
Its a poor system that enables your competition to have your items removed WITHOUT investigation whilst keeping their identical listings on. Anyway I received my first email from ebay today reguarding the suspension.....AND SO THE RUN AROUND BEGINS...

Ebay rarely pull listings without a quick check. It is only a quick check though and their decisions are not always consistent. When my listing for the Dirty Dancing video was pulled there were still lots for sale, and i bet there are still some up there even now.

Ebay freely admits it doesn't monitor auctions (unless key words from banned items are in the title in which case the item is flagged for checking). So your competition reports an item questioning authenticity, ebay will often remove it to be on the safe side. I sold genuine Vuitton items for a while and it happened to me.0
