I would like to apologise to all who feel offended by anything that I have posted in any of the posts above.

Hope you can sort things out with your mum sleepy. I'm sure she would just feel so much better if you told her you are trying to get stuff sorted out asap. I would still like all your help if possible...
My Mum needs approx £930 to get by each month.
Rent - £450 - fair price for the area.
Gas / Elec - £35
Food - £120
Water - £20
Council Tax - £75
Other Basics - £30
Cigarettes - £200 - she had tried EVERYTHING to quit!
She gets around £250 from my Dad's pension, I send around another £250 each month, but she is still going to be short around £400 each month.0 -
The DWP have advised that she should be earning 50p in the £100 each week in interest from the money she has lent me.
From what I can work out, this is equivalent to 10% Interest per annum NET – does this Interest Rate seems quite high to me in the current rate Economic Climate with our Bank of England rate at 1.5%?
The DWP have advised that 10% Interest on £37,000 would give £74 per week.
If a more realistic rate of 5% Interest was used, this would provide £37 per week.
Going back to the £124.05 that the DWP says that a person needs to live on...
Dads Pension provides £58 / week
5% Interest provides £37 / week
The Shortfall then would be £29.05 each week which apparently would be made up by Pension Credit. As I understand, if Pension Credit is paid, she would then be automatically entitled to Housing Benefit, Council Tax payment. Does anyone know if this is true?0 -
Yes, all the money will go straight to my Mother as soon as the House is sold.
If the House is not sold in the next couple of weeks, I was planning to go Bankcrupt, but this would not change the situation according to the DSS.
I do take all the blame for the situation. I meant that my Mum was stupid for lending me the money, NOT that she is stupid. I have edited that post to prevent any other misunderstanding. I do love my Mum even though we are apart.
Not sure about a DMP but as I understand it if you go bankrupt then your mother is just one of a list of people you owe money too and she cannot take precedence over the others.0 -

I want to offer you my deepest feelings for what is happening to you. No one has a crystal ball and you could never have forseen that your Mum and you would end up in this situation. Please contact Cititzens Advice or Age Concern. Your Mum should not be suffering for this situation. It would appear from what i have read that your Mum is being treated as having a 'notional income' based on the fact that she lent you this money. She is, from what you say, not receiving any return on this money. Notional income is calculated on the basis that you could get (to the best of my knowlege when i last had any) that you can receive £1 for every £500 or part thereof in interest.
Hopefully CAB will be able to contact The Pension Service on your Mum's behalf, with her authority, to explain that she is NOT getting that.
I used to work for the DSS/Pension Service for many years so understand how this situation has arisen. Your Mum/Her approved representative needs to get across that for whatever reason she is not able to receive the 'notional income' and did not forsee this situation.
It is easy to sit outside and judge. Only those in the situation can truly understand it.
I hope your Mum sorts this out to he satisfaction and you are able to reconcile.0 -

When I was speaking with the CCCS (who are great) they advised that my Mum should "Register a Caution" on the property.
I believe this is similar to a "Second Charge" on the property, but a bit more basic.
I think / hope that it will mean that my Mum will take precedence over other Creditors.0 -
We are not getting the whole story here.
What other money did she have from her house sale in 2006? Why did she sell the house?
Exactly which benefit is she receiving at present?
What money was she living off up to now?
The DWP are unlikely to pretend this amount never existed if you go bankrupt, because the fact is she still lent you the money and hence deprived herself of income. The expectation of getting the money back or not is irrelevant.
Claiming that she was not mentally capable of lending you the money is dodgy ground to go down. Firstly, it would have to be proven that she was near enough insane at the time (unlikely if she is still able to live alone, has not spent time in hospital etc). Second, there is the possibility of criminal liability on your part.Gone ... or have I?0 -
