It's kinda just pathetic?
Don't know what you sent this time but they haven't answered much about the temp Order or lighting situation.
I've asked someone else to comment re the temp Order - cos unsure of my ground there.
Hold fire for a mo and bare in mind the note above that forum closing for two days.
Is that street light working yet? I suggest researching any repair or record of that with their Highways dept (switchboard should direct you to reports about street lighting).

I strongly advise requesting a copy of the authorisation and application for the suspended bay as well as the documentation confirming when the sign or signs were erected. Also demand a complete copy of the TMO that specifies the bay as a parking bay and the section in the articles that relates to the suspension of bays and the procedure for enforcing them as well as the procedure for implementing them.
To give them further work and difficulty ask them, since the PCN was issued under the TMA 2004, what specific contravention listed in schedule 7 of the TMA 2004 did you contravene? Then ask them to confirm which legislation and where within it, gives them the authority to erect the suspension sign and then ask them to confirm whether the suspension sign used is presribed by the TSRGD 2002 or any other legislation and if it is non presribed then does it have DfT authorisation.
Tell Tower Hamlets that you need all these details to prepare your defence at adjudication and if they fail to provide these you will be asking the adjudicator to ask them why they failed.
The amount of time they will take to gather all this info may just be enough for them to not contest as the amount of man hours spent may not be worth your £120.00.
Neil B will sort you out with errors in the paperwork. That is bad enough to win on alone.
As well as the above continue to argue that the signage was inadequately placed and barely visible.
I recommend reading a couple of adjudication hearings based on suspended bay appeals. They may help give you some ideas.

Can you confirm whether the bays normal signage was covered and whether, other than the suspension notice, there was a traffic sign advising of the suspension?0 -
the only street sign that was not visible on that road was the one on the lampost that had the suspension sign on it, the rest of the signs were clearly visible.
There were no other signs on that road informing the bay was suspended.
The other thing is, do I send the appeal form off to the adjudicators & write to LBTH at the same time request the information required?0 -

Submit your appeal to PATAS (if that is your intention). make the requests to TH for anything you need for your appeal. If they fail to provide anything it weighs very heavily against them. PATAS will allow you time to submit further evidence - so no problem.
A lot of people, on and off-forums, have commented on how appalling that first rejection letter is and the explanantion, IMO, is absolute nonsense.
pay attention to what Bogs said above. he knows his stuff for areas where he is stronger than me.

I read up on a few adjudication hearings from the link Bogs gave, very interesting, There were a few situations where the suspension signs were not in close proximity to where the cars were parked & the appeal got allowed. I feel verry confident about these.
I think I'm also gona ask LBTH to provide me what the regulations are around visibilty of signs.
Guys give me a way to word that last sentence please, or shall I write as it is?0 -

I know all the answers but do they? Many parking dept staff are not that familiar with the wider legislation that control such things and will bluff all the way until a few days before adjudication where they withdraw rather than admit their ignorance.
If they do manage to answer all the questions then you have other aces up your sleeve. For example you say they did not cover up the normal signage for the bay. This goes against the legislation. see 7(c)

I have to look at the video footage I made with my phone & see if any thing is visible then I may be able to tell you exactly what it says.
Looking at the video you can make out some of the writing & they erected the suspension sign directly under the normal sign.
Have a look if you can make out what the sign says, I cant make out much (I should have held the camera still).

Hey GUYS!!!! LBTH did not contest my appeal, after reading some of the cases from the link in post #19 that Bogs gave me I decided not to write the letter to LBTH.
But just filled out the patas form telling them "if the bay is suspended 24/7 then shouldn't the suspension sign be visible 24/7 so that drivers are aware it". Today I recieved a letter from PATAS telling me LBTH have informed them that they will not contest.
Guys I owe that to you both Neil & Bogs, thanks for the advice guys it was more than helpfull.
Now I'm thinking about writing another letter to LBTH just to take the pi** out of them & have a little laugh.... What do you recon??? is it worth it or shall I let it be?0
