Regulations on lighting of signs

Hi All,
Please excuse me if I have made tis post in the wrong area.
I need som advise on my situation with a parking ticket I received, I normally park on Walden street in London E1 on Friday evening after dark which I did regularly for about 3 months. there is a new build taking place there parking ristrictions apply up until 5:30pm.
On 21/11/08 I parked on the street in front of the building site around 6pm & when I returned just a little after 9pm, I found I was ticketed for parking in a suspended bay.
The only thing was it took me about 5 mins to find the sign to say it was supended there, The sign had been put up on an lamp post which is not working & it is literally not visible to the eye unless you are standing directly in front of the sign, about 4 cars had tickets on them.
I took pictures & a video clip on my phone to appeal it, and sent off the apeal last year only for Tower Hamlets council to write back to me earlier this month asking me to pay up the full amount.
The letter did not even give any reason or details of why I had to pay up, they did not even acknowledg that they read my appeal.
I did not pay that one now they have writen to pay £120 or appeal again & I want to write back to them with some regulations around lighting of signs, because I'm sure there is some thing out there that states it is not right giving tickets when the signs are not visible.
well that concludes my story.
Can somone out there let me know if there are any regulations regarding lighting around signs that are put up, the letter came through this morning & I have 28 days to reply.
I'm realy sory I had to make it this long, but it pretty much explains everything...

Without seeing all the documents it's hard to comment. You say 'letter' but that most recent one sounds like the Notice to Owner.
Scan them up - and those pics.
To suspend a bay the Council have to complete a bit of paperwork - something like a temporary Order. You could ask for details of that in case they've cocked up. Also ask for the CEOs notes and any photo evidence they have - sounds like their own pic of the sign will be interesting.

That is one of the funniest rejections I've seen! We refer to your PCN - and therefore give us the money! LOL Nothing in between! They normally have the decency to at least talk rubbish.

Thats what I mean, I had a better response from LBN when I parked on a out of service bus stop & they sent a ticket through the post, they had to let it go, but warned me never to park on a bus stop again regardless in service or not.
It's obvious LBTH don't have a clue & want to take the Pi*s, even though they are in the wrong, its understandable if I had parked in the daylight, the sign would be visible.
But in the dark there aint chance in hell you would ever look at that lamp post with the sign if you parked your car there.0 -
Yes that rejection is very much in your favour. I can't see them risking that in front of an Adjudicator.
I would have said a good idea to research the temp Order for suspension but i think you can save your self some time now. as they failed to respond in any way you can just insist on them providing it.
So - for Formal Reps.
Procedural impropriety. A clear failure to consider the informal appeal as is required by law.
Contravention did not occur. Inadequate and unclear signage.
NtO fetters your right of appeal as Peter mentioned.
Specifically request full details of their authority to suspend the bay and the Order that covered it.
Also all photographic evidence of the alleged contravention (they then shouldn't be able to use any later they hold back now)
End with 'In the unlikely event that you do not cancel the PCN I shall have no hesitation in proceeding to the independent Adjudicator.
If they are stooopid enough to reject we can enhance with qutes of the legislation but not necessary now. Best of luck, let us know.0 -

They also sent me the form to appeal to the adjudicators, which I intend to do.
It does say in the form they get all the documents from the local authority, does this mean I do not need to attach any evidence with the form?
please let me know what you think I should do...

Seriously mate, I have seen a lot but rarely anything sooooo bad. i can't even start to list it tonight.
I never tell anybody what to decide but I am glad you are taking it to the Adjudicator! You should note that it is extremely unlikely that they will contest anything you submit to the Adjudicator. It is just tooooooo bad!
i will post more constructively within a few days, maybe tomorrow.
