AOL problem (not refunding money)

HI,

A long time ago i used to have broadband supplied by AOL, I stopped that service sometime in early 07 and moved to a different provider. I have only recently realised that AOL have still been taking money from my CC at £25pm. I have phoned to complain about this and have been told that due to their T&C's I can only claim back the last 6 months (an offer which i kindly refused).

Now you are probably wondering why i never noticed that i was being charged £25 a month - it was being paid through a Egg credit card which had a small balance on it so i set up a DD from my bank account to pay each month towards that balance and left it at that - it's only recently i decided to check if the balance was close to being paid off - obviously it wasn't and with interest and what not i'm owing quite a lot now.

Now my question is - can i claim the whole amount back from aol somehow or am i tied to their T&C's. I know ultimately it was my fault for not spotting this earlier but they could just have easily checked to see why they were billing a closed account.

I am quite angry about this and it feels that I've been stolen from - and you would think AOL would want to put it right.

Anyway any advice appreciated.

    You may be able to dispute this with the credit card if AOL dont refund it

    Were you still in a contract with them when you switched provider? Or had you finished your minimum term with them and the moved to a new provider?
  • Hi, at the time of the move I was running on a monthly contract. I have contacted Egg but they told me to resolve the dispute with aol.
  • Dont worry son, under the T's&C's of Direct Debit Guarentee, no one can take your money out of your account without your permission. As AOL have taken money out of your account without your permission, you're entitled to a full refund from your bank

    All you need to do is call your bank and mension the Ts&Cs of the Direct Debit Guarentee and Bob's your uncle, you should get ALL your money back without any arguement.

    Its different with a credit card which i assume it is from your post. They've taken your money without permission so egg is equally liable they try and push you back to AOL, just them you have been billed for a service you never received.

    My sister had something similar with her egg card with virgin, they kept taking the money as egg couldnt stop it but they refunded it straight away.

    This is the BIG problem with signing up for regular payments for anything with a credit card! basically NEVER do it, as only the payee can stop the payments, you can't, and what's even worse cancelling the card doesn't solve the problem as you're still liable as long as the payee keeps taking it.

    My daughter had a similar problem with AOL some years ago, not as long term as yours, and did eventually get it back from AOL. That was when AOL UK was part of US AOL, whereas now they're part of Carphone Wharehouse so things may have changed

    Same here 6months offer of refund.

    3.3.12 You must inform us of any billing problems or discrepancies within 180 days after they first appear on your bill - you can view your bill at http://myaolbroadband.co.uk/billing. Otherwise, you agree that you waive your right to dispute such problems.

    (they must get a lot of billings disputes to have such a limited timeframe)

  • Quick update, got a call from AOL today offering me the full refund - June 07 to present which I gladly accepted. I have no idea what made them change their mind as they were not budging from their T&C's previously. Anyway they have emailed me confirmation and I'm going to give this to egg to show that those transactions shouldn't have taken place and maybe they'll refund the interest on the account. They way they have been so far I'll probably have to fight for it but nothing ventured nothing gained I suppose.

    You should try AOL for the interest costs, as its them that's caused them, not Egg.

    i work for egg an as its an online account its down to you to monitor it an we will not refund the money as its your error, aol on the other hand should as you can take them to a tribual for this

    egg will not refund the interest either as its not there fault, this needs to be claimed back from aol, you can print your last 12 months statements out online to post them, i suggest blackin out anythin you dont want them to see
