but that wouldnt really help my case would it? I cant prove that i havent made it all up? they could just say that it isnt true, and how would I have a leg to stand on? am worried now!0

I kept a log of every event concerning my case for years. I constantly sent it to the CE, shared it with my MP, sent it to the Parliamentary Ombudsman and at no time did I ever make a secret of keeping it.michelefauk wrote: »but that wouldnt really help my case would it? One of the funniest moments in all the time I had to deal with the gestapo came when they phoned me about something or other and I asked them whether they remembered that I kept a record of everything that happened.
There was a long pause and then the poor little 16-yr old school leaver said something like "Oh yes, we know about you". There ended the phone call!!!
Since they have no record of anything that happens, who can more obviously prove truth? Clearly the only one with any idea of what's going on at all.

Well as the gorgeous creature couldn't speak she would certainly have had to put everything in writing should she ever have had the need to deal with the csa!

Finally heard back from Troy Tempest. he does NOT withold my complaint that 11 months is too long to wait for an assessment, he said that things were going on behind the scenes that he is unable to disclose to me. Doesnt change the outcome though does it? He also suggested that I arrange direct payments through the NRP as the CSA havent been successful, again not an option. On the point I made that why was an interim maintenance assessment not made which it says would happen in the CSA literature (it says that if the NRP does not provide the info, then an IMA can be made) Troy says that there is no timescale to when the info should be provided by the NRP or their employer and the CSA will wait a very long time before, if ever, resorting to an IMA.
he says he is awaiting my clerical file before he will comment on the incident with the manager being so rude to me, and when i get the reply from that, i can then choose to take my complaint to the Review team, should I feel it necessary. In his opinion the CSA have not been unreasonable in their actions and have not caused unecessary delays etc etc. He kept reiterating the fact that things are going on that I am unaware of due to the nature of the case, yeah yeah, doesnt change a thing

Take it higher - it is definately excessive to wait 11 months for an assessment to be done for lack of action taken by the CSA. Go to the Chief Exec and then take it to ICE.0

Hmm there own booklet proudly setting out their expectations of service has now disappeared off the website
Still, some of us can remember 
For an assessment is is 6 months in the most extreme of circumstances - that is on the basis of the csa being prompt with all reminders etc - now I am :rotfl: :rotfl: :rotfl: at that thought.
As Kellogs says, take it further. I have a sneaky feeling that the csa are not allowed to award any compensation themselves and just hope that no-one realise how far up the chain they need to go ;0)0 -
Yes indeed, I will be taking it further, and note that my MP who Igot involved has not come back to me either, I guess she has just passed it to the CSA for them to deal with.
Just had another letter today to say that they have done another assessment (very quickly this time, funny how it only took 2 months instead of 11!) and have set up a DEO for the monthly maintenance (no mention of arrears) which will be in place by 19th April 2009, I wont be holding my breath as I am sure the NRPs employers will stall and stall. The CSA also said that as the NRP failed to turn up for his Committal hearing , a warrant has been issued for his arrest. Again, no idea what will happen with that, they have to catch him first
Edited to say that they have also set up a payment plan for the arrears, at a rate which would take him 9 1/2 years to pay off, assuming he pays any of it of course0 -
another update, blimey the CSA have been busy this week!
they do not uphold my complaint about the member of staff due to lack of evidence. My call was not recorded as I am on the old system. They have spoken to themember of staff who denies he dealt with me in a way that was unacceptable (he would say that wouldnt he!)
The other 2 outstanding complaints : they do not uphold that 11 months was too long to wait for an assessment nor do they agree that they should have put in place an IMA in the meantime. If I am not happy with this response, I can take it to the next level (the review team in Newcastle) who will look at it again, will they just side with what the complaints team have already said? If I am then not happy, I am to go to the ICE. I have asked for it to be loked at by the review team, I will then go to the ICE.
Re the committal hearing, a 2nd date has been set for later this month, I asked how that happened and they just said that contact has been made with the NRP and a date has been set. As far as I understood it, once the NRP failed to turn up for the original committal hearing , a warrant was issued for their arrest and that was it, didnt realise they were given another chance to appear in court? Although from past history, the CSA seem to love giving my ex lots of chances! The ex came over yesterday to see our son as it was his birthday, pulled out a great big wadge of cash from his pocket for his birthday present, I had to go in the other room before I said something I would regret.0 -
Afaik they can.
