    Fantastic news! I always knew you'd win, but well done for having the tenacity to see it through to the end.

    I'm reliably informed that B&Q are now falling over themselves to settle other claims in full before the hearing dates - I promise to post an update on this in the next few days but can't say any more right now.

    He won't get anywhere as B&Q clearly has an exemption clause in their T&Cs, which everyone agreed to when ordering the product.
    There TOS clearly states they have not broken a contract (as does most retailers TOS). Their sensible response was the apology about a system error, and a refund of the monies. That is the end of it.

    I am ready to be proved wrong and look forward to seeing your cheque for £260 from B&Q for having an item not in stock. Honestly.

    You won't get a positive response. It was an item that sold out, and they refunded you. If you think you may actually get anything more than a "sorry it sold out" letter/email then you are in cloud coockoo land. I am sure the usual suspects will reply to this post saying "bleh blah bleh" but at the end of the day you aren't going to get jack s*&t out of this so save your time and do something more productive.
    I think its more likely the claim will be laughed out of court than the defence. Lets face it.
    It was quote of the year for these forums sueing for "loss of bargain".

    Well done, I still have my corrspondence and paperwork and have sent off to customer services asking the position of delivery in view of this ruling and would they like to save further court costs?

    Just hope the know nothing barrack room layers above have the face to apologise to you.

    We bought one of these B&Q dishwashers, made the payment online and contacted B&Q customer services to see what was going on, to be told that it was being cancelled. No payment was taken.

    Im sure there will be others like this,

    I dont follow law, im just a dumb aircraft technician. What does this mean.?

    the judgment is of course based on my presentation, the facts i passed over and of course the lack of prep work done by B&Q. I could really tell the lady from B&Q hated me, but her employers should really consider whether their staff thought they really are up to the job.

    If you do fight this in court, remember to ask B&Q how many they had in stock (7), ask them if they could have got more in (no) and then ask how 'discretion' plays a part. When you have no stock, you cannot therefore have any discretion.

    It certainly doesn't create any kind of precedent, but there's no harm in writing, asking if they will either provide the dishwasher, or pay you for loss of the bargain.

    I imagine they'll tell everyone to get lost, and just see how many people have the balls to issue.

    if this is the case and B&Q see more cases in court, i am happy to set up a guideline claim and argument point for all.

    just had to say that I didnt agree with the comments shown in the above quote or write anything in this thread except to show that it reappeared but I never thought any of you would win so congrats to Beckett, a great win for the small person and a well presented case hope other follow you:beer:

    Congratulations i am really pleased for you. Thank you as you have given me (and probably many others) the confidence to go ahead and submit a claim. It is much easier to do this when someone has had a postive Judgement. I wrote to them in February but they didn't bother to respond. I am now going to write to them again and if they do not reply I fully intend to submit a claim to the court.
