If you're fully comp the normal procedure for a non~fault claim is for your insurers to repair your car or offer you a settlement if written off, then they would claim this amount back from the TP insurers. They would deduct your excess which is then left to you to claim back from TP insurers either yourselves or using a Legal policy.
However, as your insurers are voiding your policy for non~disclosures, they will not pay out for your car, BUT as the claim wasn't your fault you can still claim back from TP insurers yourselves. I would suggest writing to the TP company and request reimbursement.
Have HSBC given you 7 days RTA cover in the letter? You should have 7 days before they cancel a policy (well that's how the company I worked for did it) allowing you time to arrange another policy.
Alternatively you could argue the point that how could you advise them of a speeding conviction that you weren't aware of at the time of buying a policy, but I'm not too sure how you'd stand on that one.

Thanks for that! Useful info - whats RTA by the way? they offered us a settlement figure about three weeks ago and asked us to send the log book, mot cert and insurance cert to them which we did. They are now asking us for the certificate back!! No need to have insurance as we haven't got the car in question.
I have raised an official complaint with HSBC - I will speak to TP people on Monday. My real complaint is its taken them nearly 8 weeks to come to this conclusion when really we should just have been dealing with TP insurers anyway but they seemed to be too keen on pushing us to put a claim in for personal injuries..i think as it was a motorway accident they expected a big claim...as they said 'how could you have NOT been injured':mad:Quality is doing something right when no one is looking - Henry Ford

Just went to open the bottle of wine I bought today which I had put in the wine rack and I noticed that wine was dripping out of the unopened bottle.
The cork must me damagad and the wine is off:eek:

RTA ~ is Road Traffic Act, normally they have to give you 7 days notice they are cancelling/voiding a policy and this is the time to allow you to arrange alternative insurance. But yeah as you said you don't need insurance! Doh. Been almost a year since I worked in insurance so am rusty.
That does seem a long time, and can't understand why they'd push for a PI claim as they wouldn't benefit from it? Bizarre.
How was you DH caught speeding? Was it on a camera, because if so, then you honestly didn't know anything was pending... did they find out from his licence?
