warranty issue and black horse

Hi all
Im new to this site but have found some of the posts very interesting. I have a mega issue going on at the mo and wondered if anyone has been in a similar situation and if so what was the outcome?
Are you sitting comfortably? Then i shall begin!
My hubby bought me my dream car for my 40th birthday and a couple of days after owning we noticed a clanking noise when selecting gears. We took it back to the dealership who claimed they had adjusted the linkage.
This was back in May last year and then on 1st November we lost gear 5th gear altogether. We took it back to the dealer and they advised they would have to send it away as they could not fault it. At this point i asked would it be covered by warranty and they said it should be. It sat in their compound for 4 days before they even sent it away and then two days later they called and said it was down to wear and tear and that the 5th gear synchro ring was damaged due to the clutch being worn and would not be covered by warranty!!!!!!! We had only done 2000 miles and were gutted by this and the fight began and continues!!!! We tried to tell them if it was down to wear and tear then it had been sold as such but they refused to budge!!
We then got Black horse involved after taking advice from consumer direct and they suggested we get an independant inspection carried out. We did this and the report came back stating that it was infact mech failure as a result of dog teeth breaking on the 5th syncro dog gear. Success!!! or so we thought. We sent this off to Black horse and waited and waited numerous phone calls getting us nowhere! Weeks pass and we get a letter from Black Horse stating the dealer does not accept the findings of our report and is having another carried out! Weeks pass yet again and then we get a copy of their report stating that it was defective operation of the clutch and clutch drag that have caused the problem. The clutch is also blue and mottled in appearance and scorched. Black Horse reject our claim and state thats the final decision. We bite the bullet and borrow money to get the necessary repairs done and return the hire car that has cost well over a grand. Last friday we get a call to say the cars ready. We insisted that we got the parts back that had been replaced. The clutch is perfectly normal (no blue marks) and could have gone back into the car. We have never missed a payment on finance while this saga has been going on and we have now passed this matter over to the financial ombudsman who we are hoping will see our side of things. BLACK HORSE STINK! Any similar stories or experience of dealing with the ombudsman i would love to hear them.

This has been posted countless times before and I will tell you what you were told by everyone on those times.
It was an old car - not brand new - old cars wear and tear and it was reasonable for the gear box to go. It was not covered by the warranty.
Just because you bought an ego car doesnt mean you have added rights about the mechanics of it.
People like you should be forced to pay the cost of dealing with your continous pointless claims with no justification0 -
Having read all of your posts..why so many on the same subject? it does appear that you have an attitude problem. Maybe that is why you didnt get any help from the dealer or black horse. If you really think you have a case then you need a solicitor or take it to the small claims court.0

Lina it is quite obvious that you know absolutely nothing!!!! If you cant post positive replies keep your stupid opinion to yourself! This car was not purchased as an ego boost and neither is it old. We work hard to make payments on this car! Dont comment on something you clearly have no knowledge of!! This site would benefit to be well rid of people like you!0

If I recall the car is old enough to not have a manufacturer warranty, and also old enough to need a new gear box
Can I suggest you !!!! off and hopefully go bankrupt chasing this in court since you ignore all the advice you get.0 -

To rest of you yes i have posted previously but the only advice i received was to move the post to the motoring section!!!

Sounds like unforeseen mechnical faliure to me exactly what a warranty is for.
I worked for a small warranty company and this sort of claim would have been paid without question.
Even if the clutch is worn the gear box should not fall apart.
If the warranty company does not want to cover vheicles over an age or milage then they should say so (ie not sell the policy).
Sound like you are on the right track with the FOS claim.0 -
Thank you for your reply mx5 somebody with some sense for a change. I am also getting a report done from a local garage that i took the car into to get it checked over before i took it back to the dealer so i knew there were no major problems. I just cant see that the ombudsman will not see my side of the story with all the evidence i have. The dealership told me they had a report initially but they didnt and totally dismissed my report on sayso!!!!
Just to add i had an mx5 and it was great and served me well with no problems...great summer motoring fun.

did you at any point mention the financial ombudsman to black horse?
you should have if you didnt, usually it speeds things up a little.
i would expect a gearbox to be covered under a manufaturer warranty,if serviced to manufacturers spec.
but what i wouldnt expect is an independant warranty company to cover it as i doubt they have a servicing spec,so how can any warranty claim be valid?
another reason why warranties arent worth the paper they are written on.
oh, and op, honest replies are better than just positive ones.
good luck in getting your money out of them one way or another.
as others have said, if they wont cover things like this then they shouldnt offer warranty....work permit granted!0
