Hello all
right where to start!!!
i make monthly payments to Equita at the end of every month when i get paid, due to it being christmas i sent the cheque on christmas eve. having checked my bank this was cashed on the 5nd Jan by Equita, which sounded correct due to the christmas period.
i have today (15/01/2009) just received two letters from Equita the 1st is dated 07/01/2009 stating to agree a suitable payment plan???? the 2nd letter received today (15/01/09) (same day) was dated 08/01/2009 notifying me that despite numerous communications and baliff visits (havent had any letters or cards through the post, so unsure what they mean here, surely this is illegal as its charges for nothing) that i have failed to pay the outstanding balance of £546.30.
So they have given me 1 day to respond even though they sent both letters 2nd class, and i have only received them today.
i hadnt even known i had any problem with this account until today after receiving these letters. i phoned Equita straight away and mentioned the fact about dates of letters and that my cheque had been cashed in early Jan. they told me there is nothing they can do and that it has gone to Mr Valentine as to which they gave me a mobile number, which i called and straight away, a foul mouthed man answered the phone and i told him that my case had been pasted to him and i needed to set up a payment plan, he said to me "this is not possible, i will come round on Saturday and either take the full payment or remove your goods."
i am a single mum and only work part time, i have kept up with my side of the deal with them by paying, but they do not want to co-operate i cannot afford to pay this off in full, but can continue making the monthly payments (which i never stopped!) i live in rented accommodation which is fully furnished as stated on my tanancy agreement. im worried they will just take my car (worth £4000) if its sitting on the drive when they call.
Please can someone advise me on this and what they can and cant do. i dont answer the door anyway due to living alone, i only answer if i know people are coming around so i know i wont open the door to them anyway.

What is this debt for and can you please type out exactly what was written in the scone letter, or ring one of the debt charities - they are free and open until 8pm

Is it a CCJ debt that they "claim" you have not paid on time? If not then he has as much right to come into your property and seize goods as a paperboy and if he turns up don't open the door but tell him THROUGH it that he can smeg off and you are calling the cops. Unless he's a Bailif and the debt as gone through a CCJ then they can do NOTHING!DFW Nerd #025DFW no more! Officially debt free 2017 - now joining the MFW's!

Failure to do so will result in our Baliffs calling to enfore the Liablity Order held against you.

Unless the outstanding Council Tax is cleared by return, i will have no alternantive but to instruct my baliff to call and remove your goods to be sold at public auction.
This action will involve you in considerable further, expense, which will be deducted from the proceeds of the sale.

i presume this is a CCJ as they have adate from a Magistrates liability order, it is a baliff who is coming round also!! please help, i will go to citizens advise tomorrow, but i cannot stop worrying about this!0 -

And I am confused as to how haley is having to pay so much council,tax if she is only in part-time work as a singel parent?

this debt is from my previous property, i was renting, i thought the coucil tax was included in the rent as i was paying so much, this was my first property so didnt know, maybe i should have looked this up. i am now a single mum since Sept and get 25 % off my council tax in this property. if that makes sense!0

i know this is based on what tax credits you get! i work 3 days a week, i am unsure as to why i dont get council tax benefit i get housing benefit and am on the highest rate fro tax credits, i did query this a while ago with the council they just said i wasnt eligable!0

Then find the name of the bailiff and the company and email them. Herbie21 as been on here in the last few days but her message box here is full. Or ring her on the number on the web-site, although it costs.
Tomorrow can you ring one of the debt charities (preferabley CCCS as they have a dediciated benefits section).
