sorry i missed that question - yes i did receive this, the reason the debt was so much was because Equita put charges on top of the actual amount, they added on about £250. i will contact Herbie21 and thanks again.0

Ok
There should be court charges and they are entitled to £70 ish for two visits, if they have visited. Otherwise, there should be no charges.
Please speak to Herbie about the charges. If you've have not made a mistake, you've made nothing0 -
I am so sorry but it has been a busy day. Many of you may have read the thread that I started today concerning the pensioner who had a heart attack after being taken to the Ash Point machine by bailiffs. An awful story and proves once again that this industry desperatly needs regulations and quick.
Coming back to your problem. I am so pleased that the debt is to be sent back to the council. I would suggest waiting a few days for this to happen and then send a Subject Access Request to Equita to request a complete breakdown of the fees and charges. From the information that you have provided the bailiff should have charged you just £24.50 for a first visit and possibly £18.00 for a second visit.
We have had so many complaints that some Equita bailiffs are stating that they can charge an "Enforcement Fee" of £160. It may well be the case that they are charging this fee......but it is not a legal charge.
For the Subject Access Request letter, I have sent you a PM with the password to access one from our website and any template letters but for anyone elso a copy is below:
(Enter date)
Dear Sirs,
SUBJECT ACCESS REQUEST ( S.7.)
Dear Sirs,
Re: (Enter you reference details.)
The purpose of this letter is to make a Subject Access Request pursuant to Section 7 of the Data Protection Act 1998, as I object to the level of fees that have been applied to my particular case.
Accordingly, could you please provide me with a full and detailed breakdown of the actual costs that have been applied to my account by your company.
I also require a copy of the Liability Order from (local authority)
Could you also provide me the name of the Certificated Bailiff, and the date and court details where he gained his certificate and confirmation also that his certificate provides from him to work for your company.
Please find enclosed a cheque for £10.00 payable to (relevant bailiff company).Could you please confirm that this request has been received. I am enclosing a stamped addressed envelope for this purpose.
I look forward to receiving this information as soon as possible, but in any event, within the strict time limits imposed under the above Act.
Yours Faithfully.0 -
