is this a low offer?

  • I thought the ceiling on whiplash is approx £2500.00 - 3k, obviously taking into account pain etc. I would hold out but you need to see a solicitor if you don't have one.
Wow, I got 3 *, when did that happen :j:T:p
It is not illegal to open another persons mail unless you intend to commit fraud - this is frequently incorrectly posted:)
    I live in my head - I find it's safer there:p

People complain about high premiums, these are the same people that go to a solicitor......

The injury payments are the same, just the solicitors get a silly amount of fees.

    I disagree.
I think a solicitor will be able to get a higher offer for this inividual (from the informtaion provided).
My MIL recently got £4K which she would not have got without a solicitor. Before the solicitor was involved she was offered nothing, so how can you say the payements are the same??

You'll get no argument from me there.
In my MILs case I think the solicitor got around about he same £4K figure.

    Not true.

In any event the OP has a lower back injury, which is worth more than whiplash, generally speaking.

To the OP, I would not accept anything this soon after the accident as you don't know the long term prognosis - as others have said, yours is a complicated medical situation and you would be best advised to get a solicitor to act on your behalf.

Don't expect it to be resolved quickly though.

Solicitors fees are fixed for motor injury claims up to a certain amount.

It is also worth knowing that the legal time in which you can put in a claims is 3 years.

I know you will want it done & dusted but as others have said the long term consequences of injuries or the recovery time may be difficult to assess very quickly especially in your complex case.
It might be in your interests to relax a little and see how you progress.

Whilst I understand the need not to have things drag on, you do have 3 years legally speaking.
  • It is a shame that most of the above advice, particularly posts 7 and 15, was given to OP in an earlier thread. He has chosen not to seek legal advice or allow symtoms to settle and has continued to deal direct with the insurer.

OP is now in a position where he needs to get a solicitor to take this matter on, despite the fact that he may have prejudiced the position & Saga have instructed an expert of their choosing. Current medical report does not sound very 'claimant friendly' and does not appear to recommend additional exams.

Despite OP wanting the matter settled quickly it sounds like one or more extra examinations will now be needed to achieve a decent settlement.......

How has the position been prejudiced?
  • Because this first medical report is not going to disappear and could be used by Saga to counter future reports.

Don't get me wrong, I'm not saying it's definitely a problem but it's not an ideal scenario and could have been avoided.

The OP asks if this is a decent offer.
Is loss of earnings part of the claim?
He also says the accident has caused depression but then goes on to say he had that before the accident.
All seems a bit vague to give any sort of opinion.

All seems a bit vague to give any sort of opinion.

It does need proper assesment and we clearly have limited information.
But £500 for not being able to carry out basic essential task (like cooking and walking) seems like a complete joke to me.

My MIL had a cut on her leg (caused by the edge of a workmans tool box left on the floor).
It was quite a bad cut which took a long time to heal becuase of her advanced age.
She had to have many visits for her leg to be dressed, but at the end of the day it was just a cut and she is retired so no loss of income.
She got £4000 for her cut which is now healed after a few months leaving a scar.

I had a bruise about 15 years ago.
It was a bad bruise that took many months to dissapear and I still have a bit of a lump there but I got £1600 just for a bruise.

These seem relatively minor and straightforward compared with the OPs case.

Of course there is much more information required which only professionals can assess but I'm quite confident that the OP would get quite a bit more if they got the proper advice.
It will however require some medical visits and a long wait.

Perhaps the OP needs to tell us why they haven't gone down this route if they were advised to do this before.
