following my RTA on the 18th of last month i have had a medical and saga has offered me £1750 for lower back whiplash, a serious worseningn of preexisting leg pain, depression and anziety which they claim will be sorted in 6 months.
initialy they offered £500
are they still trying to take the !!!!? i cant walk properly for any distance without severe pain, i cant cook, cant take part let alone enjoy my hobbies, and i cant have sex because it hurts far to mch.
i dont think they have taken ANY of the social effects into account when making the offer
realy what should i be looking at?

Why don't you get a "no win no fee" soicitor.
I am no expert on this, but it sounds far too low.
I would have thought serverla thousand.
Why don't you get proper advice and get someone qualified to fight your corner?
They get their costs from the other side so it costs you nothing.0 -
Did you seek legal advice? It may not be too late to do so.
Have you seen and agreed the medical report?0 -
"depression and anxiety"
Jog on you scamming !!!!:mad:0 -
Ignore him Paul, he's always trying to wind people up.
I think a lot of people would be depressed in your situation.
If you get a solicitor your would have to get medical reports done, so it's not that easy just to scam money.
I had my anxiety measured by a clinical psycologist before after an accident.0 -
seeing as i already suffer from diagnosed depression which is under mental heathcare treatment you !!!!ing retard and it has made it worth with the extra level of hassel, pain and general crap which happens at a time like this i am not a scamming !!!!.
i havnt seen a soliciter as yet but i am going to tomorrow
i havnt seen the report yet but should be in a fw days.0 -
You wont be able to tell whether they've made a reasonable offer until you've seen the medical evidence they've obtained - they will pitch their offer based on that, so it depends whether the doctor has estimated your recovery at a week/a month/a year etc
It also sounds like you also need a psychological/psychiatric report also which should be able to estimate the exaccerbation of your preexisting condition- again without this report, they can only have put in a token gesture for any psych injury so you/your solicitor should ensure that a report will deal with this aspect.
Although the orthopaedic/gp/a&e report you've already had might make some assessment of this type of injury, unless psychiatric illness is their equal speciality (unlikely) then the doctor is not qualified to make any assessment of anything other than the physical injury you' ve sustained.
If you require any cognitive behavioural therapy to deal with the additional psychiatric issues that the rta has caused, this will be recommended and should also be paid for privately by the responsible party's insurer.
Ordinarily I might be telling you that you can deal with this yourself, but really as your injury is complex in nature - specifically because you have both pre existing physical injuries and also a history of depression, then really in your case you need a solicitor to protect your interests here and ensure that you obtain a fair settlement.
The insurers aren't necessarily out to take the pee, but you need to ensure that the dr report that's been done mentions all your ongoing symptoms, and a separate specialists report has been done regarding the depression, so that they can value it accurately.

Its caused you such distress and anxiety that less than a month later your more concerned with your compo claim than health.0

noo its saga who are making the offer to me at such a short notice and i am feeling presurised to accept something when i dont know anything about it hence me asking is it a low offer.
also given the fact that in under a months time i will be in hospital for 2 weeks followed by considerable time spent flatbound i do actaly need to act sooner or else it will be ages before i am able to sort things out0 -
You are being made an offer at short notice because they hope you will be motivated by the fact that it will all be "done & dusted" quickly.
It's in their interests to do this as they won't be paying any costs if you have no legal advice.also given the fact that in under a months time i will be in hospital for 2 weeks followed by considerable time spent flatbound i do actaly need to act sooner or else it will be ages before i am able to sort things out
Do you not have any friends, family, relatives or colleagues who could visit you and help sort out your correspondance?
I'm sure it would take a weight off your mind.
