The CSA's document "CSA 2001" states that "In some cases, non-resident parents may get tax relief on their child maintenance payments".
Does anyone know what these cases are ?0 -

can anyone advise me on how to take absent parents to court for non mayment of child support........... i have for the past 10and a half years had parental responsibility for my grandson who was taken away from his mother (my daughter) when he was a baby as he was very badly beaten up.we havent seen his mother and she wont pay any maintenance despite having a csa assessment against her...........grandsons father dissapeared to new zealand so he wouldnt have to pay any money he also has a csa assesment against him but its like banging head against wall trying to cantact the csa i have rang them that many times the telephone company have added their number to family and friends !!!!!!!!!!!!!!!!!so thought i might try and take them to court dont see why they should be allowed to shirk there responsibilities sorry for going on you can see that it is really hacking me off any advice would be appreciated

You may not be able to go to court. I live in scotland and you should bear in mind Scottish law does have differences. However it is my understanding that the csa, not courts deal with child support. This is very frustrating when you are dealing with an evasive payer as the csa are remarkably bad at collecting money from non payers. Might be an idea to phone the citizen's advise and see what they have to say.
I made 170 phone calls to the CSA in six months at one point. They always passed me around departments, no-one was willing to take responsibilty. When all other excuses failed they said the computer system was down. Out of total frustration I gave them a warning that in 7 days I was going to the press. On day 6 the problem was sorted! Do log your calls and claim the cost back from them.0 -
Sorry to hear of your troubles, however a hard lesson I have learnt is not to include child maintenance payments when working out your monthly budget. When mine stopped I was £50 a week short of what I needed and we were living on a tight budget.
If you can prove somehow that the CSA SHOULD have collected money yet failed to do so, then you may have a case. There is unfortunately no law against the absent parent being a sidling devious lying shyster.:)Member no.1 of the 'I'm not in a clique' group :rotfl:

I obtained a Court order many years ago (and prior to CSA coming into being) stating that my ex should pay X amount of maintenance to me for the benefit of my daughter. When my ex decided to stop paying (even though against order of the Court), I made another application to the Court for maintenance. This application was dealt with by the Court and ex now pays maintenance again.
Unsure whether I could re-apply to the Court because I originally had a Court order in place or whether this is available to all. May be worth contacting your local County Court and asking to speak to the family division who may be able to help.
Not sure from your post who you wish to take to Court - your daughter or the CSA?

You have entered into a private foster care agreement. Have you registered with social services? if not please think about doing so, there are generous allowances to be claimed, support for you and your grandson and the possibility of respite should you ever need it.
As for the CSA if your not on benefits forget it. I haven't had a penny in twelve years as I have claimed nothing from the state so I'm not a priority... grrrr ......
I don't know anything about courts but wish you lots of luck if you persue that option.0 -
thank you i was unaware about a private fostering arrangement payment as social services didnt tell me about it thats very naughty of them dont you think?????????,as i have been looking after my grandson for the past 10 years wonder if they will make a back payment he he me thinks i will have say ta ta to any payment from the csa until the government sorts it out......................grandson could be out to work by then !!!!!!!!!!!!stay lucky!

As you say your son was taken away from your daughter, I presume he was then placed with you by social services. This means that you have not entered into a private fostering arrangement. As you have parental responsibility, do you have a residence order. Fostering allowance is not payable to a person with a residence order. If you obtained the order subsequent to fostering through social services, you could have asked for a residence allowance but it can be a battle to get this and it is not something usually offered, you have to ask. It is unlikely you will get it now unless you are suffering financial hardship and even then, a remote possibility.0
