Complain very loudly about it. Request a letter explaining why they have not taken any enforcement action against the employer and for them to confirm how many months maintenance is missing and the dates.
Go to your MP and request them to assist you on this. Also, call them up and ask them to refer it to criminal compliance immediately as the employer clearly is failing in their duty and must be made aware that it is a criminal offence to fail to make these payments.
Call them weekly to find out the status also.0 -
- Brief history and then PLEASE someone tell me how my ex is managing to pull this scam?? (Because I am certain he is doing something dodgy here)
After 5 years of writing letters to my MP and my case being passed onto enforcement (where the CSA gave my ex had a liability order and a DEO for non payment and arrears of over £5000) I was finally told he should be paying me over £400 a month. I have never had that amount however as he has protected earnings. He has a new job which he started after christmas - before he started he asked me to drop the CSA and go to a private arrangement because he said they would take so much money off him that he wouldnt be able to afford to see the children anymore - but I would never agree to this with his history. But now the last 2 payments have gone down to less than £100 a month? He hasnt seen our 2 children since february now because he tells them he is working every hour godsends and cant afford to see them...??? So... he is working full time, had a promotion in his job (same employer- higher position, more hours) but his payments to me have been REDUCED? I have asked CSA to do a reassesment twice now but heard nothing? Please someone shed some light on how he can get around the system????0 -
Can someone advise do I still pay child maintenance if my son has emigrated abroad ?
Many thnaks0 -
We were in a very similar situation and my husband GAVE his ex the house and then to top it all she stopped payment half of all the 20K debts they had amassed!! and left us to pay the lot. Then to top it all she went to the CSA and they stung us for another £200.00 P/Month. We now have the task of trying to find out if the child is still at college on a full time course- all the ex has to say is yes he is no proof is needed - unlike the other way around. So, sorry to tell you it wont get better for some time yet hopefully you will be able to salvage a relationship with your child/ GOOD LUCKI have always been given advice to keep records of payments given to ex partners for child maintenance. Is it really good advice?
My ex partner and I decided not to go through CSA. I gave her a lump sum payment of £32000 to help her and my daughter plus a monthly payment of £165/month. 6 months went by and I received a letter out of the blue from the CSA stating that my ex has applied to them for child maintenance and could I send all my details.
I told the CSA that I gave her the lump sum and monthly payments already. I was told that since the application from when I should be paying was received after I paid the lump sum, this money could not be taking into consideration.
I now have to pay an extra £65 per month. Are they correct in what they are saying? and if so does this mean that this advice I have been given to keep records no good.
Sorry to burden you all with my dilemma.Im just another responsible father getting ripped off and deprived of my daughters company by an ex partner.0 -
Hi there, I read your post and I have gone through similar problems. I will be interviewing my MP over the next few weeks regarding these issues. Check out my website and leave a comment. I need to try and get as much feedback as possible in order to present my findings to my MP, so that maybe someone will start to listen. I set up the website after I decided to use Child Maintenance Issues as a study for my HNC, as this is a matter I can personally relate to. I set it up to try and get as much feeback as possible. So please visit my website leave a comment. Tell us of the problems you face. If you know anyone who have similar problems then please forward my website address. Lets try and get the word out that this is just not good enough. Thanks Ali x Unfortunately as I am a new user I am unable to send a link. The name of the website is theydeserve better and it is a.co.uk address. Any problems finding it then let me know Cheers x0

Hi there, anyone have any advice? My husband first heard from the csa when his employer informed him of a deo on his wages of £480 every 4 weeks. He has two daughters from a previous relationship of which has never been amicable. In the twElve years i have been with him the girls have been with us every weekend, school holidays and weeks at a time. He has always contRibuted finacialy and everything we do as a family with our three boys the the girls are always included. However the info that the csa have is totaly conflicting and they have only went on the word of one phone call to the girls mother. We have a copy of this. Were she has totaly lied and said the he gets them i day a WEEK for 6hours and has never gave anything to the girls upkeep. The csa also state that he has to pay £26,000 arrears also. We started an appeal then were told that this would not take into account the arrears so therefor cancelled it as. One of the girls has moved out from the mothers home now lives between us and her granparents and the csa still won,t listen. We are an extremely loving and close family and we are so proud of all our kids at hoW they are coping with the situation. Myself and my husband are both on antideppresants and sruggling daily to cope.0

HAHA only just realised this is an old post!!!!
I have read some of the threads here and have got to say there is a part of me that is feeling relieved that it's not just me who 'struggles' with the CSA.
I'm actually at the stage, after nearly 10yrs of fighting with them, at giving up! My children are now entitled to at least £30,000! My case has been passed from one office to another, been lost, been referred to court 3 times (he apparently attended once and was told to pay £5 a wk which I never received), has been locked and they could not tell me why, been told he was on benefits but I still never recieved anything, been told he started work and I still didn't receive anything, they told me the area he was living in (he didn't stick around!), what job he was doing and the list goes on and on and on.
I've made 6 complaints in the past and continuosly get conflicting information.
If only I'd saved up the money I've spent on phone calls! Oh and they say they have to call back within 48hrs if requested and they never do!
I will now get off my soap box and simply say that they are a waste of time! I'm raising the white flag and giving up! Good luck to anyone who's sticking with it! x0 -
Don't give up.
Callbacks are meant to be actioned within 24 hrs now, too.0 -
Hello, my soon to be husband has been taken to the CSA by his ex wife. Here is the situation:
- They were married for 15 years and had 3 lovely children
- She left him for another man and took the children with her
- They are now married and her new partner's children live with them for half the week.
- She has never worked and got a good settlement from the divorce.
- We see the children every other weekend and drive hundreds of miles each time to go and get them.
- My fiance has always paid, regularly, on time, an amount they decided on years ago.
- My fiance then got made redundant last year and therefore stopped paying for 3 months.
- Without warning they then took him to the CSA.
- They have never emailed us to ask for more money or threatened the CSA.
- My fiance is now willing to begin paying again (the same amount) as he now has a new job although is being paid £30k less.
- His ex wife has capacity to work but just doesn't want to.
- We have now offered them a lump sum to make up for the months he didn't pay when redundant (this is in the thousands) but they have turned it down!
I know it's not about treats but we actually got the CSA letter through while we were in Disney with the children. My fiance had been promising this trip since the marriage broke down 5 years ago and had been saving up for it for so long. Of course, when he lost his job we couldn't cancel the trip as we would have lost thousands on the flights. It just seems all wrong to me.
Plus, my fiance is thinking about going self employed as he is not sure how is new job is panning out and he has a business idea that we think will work (I persuaded him not to go with it when he got made redundant as I didn't think he's be able to pay for the kids) the irony....
Anyway, let me know what your thoughts are. We've actually done the new calculation with the CSA on the phone and it amounts to a huge extra £34 / month for the ex - not sure that this is all worth it at all.
Thank you!0 -

If you want to avoid then go self employed, if you want to pay, then don't avoid it and keep accurate figures to supply to the CSA.
Either way you will be criticised for now being one of many self employed that do so to avoid paying maintenance, it doesn't matter what the truth is, that is the way it goes...!0
