Hi All newbie here....
Dont get me started with the CSA my partner was supposed to paying £88 per week from June 8th this year by deductions of earnings and ive been ringing every week since bloody JULY!!! I have to explain to different ppl and its the same process they put me throught to Debt managment who say they will ring the employer and that i have to wait 10 days so they send it and they never do!! i spoke to some bloke Friday at the csa and i said well you can prosecute the employer if they are not sending it and his reply was well that wont get your money!!!! no but it might shock them into sending it. Apparently its on file that the employer has been taking it every week but just hasnt got round to sending it!! Oh thanks for that one!! Just my kids are here suffering because you cant be assed to send it. Im ringing them tomoz AGAIN and then im off to CAB. :mad:0 -

I assume you meant ex-partner. Put in a complaint (can do it online via csa website), it will get sorted quicker than dome-one just saying it's ok the employer has forgot to post the cheque. The employer should have made the first payment to csa on 19 July and you should have had it a week later, so you certainly have grounds for complaint.0 -
I notice most of these posts are from single mothers whose ex's won't pay for anything.
My situation is somewhat different.
I had a child with someone who tricked me and got pregnant. I had ALOT of money. As soon as she had the baby she moved out. I paid for her flat, a sports car, food, private health care, clothes in addition to a monthly lump sum of £1000 a month.
She then took me to court 2 years ago and I agreed to nearly double the monthly lump sum, as well as pay a set ammount each year for holidays and school fees on top of what I was already paying. It ammounted to over £90,000. I did not try to fight it as I wanted things to remain amicable between us for the childs sake. This was all tied up in a court order.
I do not get to see my child apart from about 2 hours a month when the mother is there to supervise. She makes everything very difficult for me.
With the credit crunch my finances changed dramatically. I have sold most of my assets and am now renting a house and have no income, looking at going bankrupt. I no longer pay for all of the things demanded of me in the court order, but it has not been officially overruled. I am struggling to still pay her about £700 a month. I think that she is waiting patiently for my situation to pick up again so that she can claim for what she is owed according to the court order.
Where do I go/ what do I do to let the courts now that I can no longer manage to pay the maintenance and a new agreement can be made?0 -
Why on earth did you agree to pay her £2000 a month on top of paying for a house, car, holidays, school fees etc!! Have you checked on the CSA website about how much you should be paying per month?0

Because at the time he agreed Karenx it sounds like he had the funds but now his circumstances have changed.
OP wait for someone like Kelloggs who is a great help but if you have no income then surely even a court order provides for a change in circumstances such as loss of a job? if your not earning it you cant give it to her my maths is cr4p and even I grasp that one. Cheer up, you have my sympathies mate, might be an idea to invest in a tin hat your going to need it once the penny drops that her gravy train has come to a grinding halt:)
If it helps we were severely credit crunched too. You do get used to having virtually nothing lol having copious amounts of cash always to hand is just so 2007:rotfl: thats what I tell the daughter when she whinges about lack of money, shes not amused and shows no signs of thawing:rotfl:

If the court order is more than 2 years old, then you can apply to the CSA yourself - they will contact the PWC. What is your net income at the moment?0

The court order isn't quite 2 years old yet, but will be soon.
It's impossible to say what my income is now, as I'm drowning in bills and everything is slowly being taken away. I also have a wife and child to take care of. Yes, it's amazing how fast you can adjust from being able to buy anything you want to cutting discount vouchers out of the newspaper!
It would be brilliant news if I could get the court order overturned in an easy manner. Should I wait until it has been 2 years before I apply to the CSA?
Is anyone clued up about custody rights? I see my daughter about once a month for an hour and the mother is nagging in my ear the whole time about money. We haven't got a formal custody agreement in place but I would like to. I just feel like I don't have a leg to stand on because I live 250miles away and there's no way she would let my daughter come and stay at my house.

Andy im sorry to say but you seem to have taking for a ride and she has manipulated you for everything she can get .
If she named you on the birth certificate and child was born after Dec 2003 you should have no problem getting access .
Hopefully one of our other experts refarding access will be along soon .

If your court order for child maintenance was made on or after 03/03/03, either parent can apply to the agency after 12 months.
If a court oder includes other maintenance ie spousal etc, you should re apply to the court.

Posted this question in it's own thread but no response as yet so here goes again...
what happens if the NRP has a deduction from earnings set up, but their company don't pay it? I know that it CAN lead to the employer being prosecuted in theory but will they actually enforce this in practise? So far husband is getting nowhere with the CSA (funny how they always assume that a male is the NRP and is calling to discuss payment - they were quite rude to him till he put them straight). The case has already gone overdue and has been escalated to a manager but still no progress - is there anyone else we can call/escalate to?0
