You wait for 12 working days, plus two to allow for posting. What date did they recieve your CCA request.
If you've have not made a mistake, you've made nothing
  • It went recorded today so they wont get it until monday i dont think, i will keep everything safe and start counting down the days.
They called my husband twice today but he ignored the calls from them, he is very laid back and really is not concerned. I on the other hand stress far too much, i asked him if he was bothered by all of this and his reply was "whats the worst that can happen, i will still have you and i will still have my kids"

Absolutely, those are what really matters.

1st Credit will not accept any payment offer over the phone. The person you speak to will be after a payment immediately so that they can earn Commission.

Send e-mail ( you get auto reply then ) telling them that you will ONLY deal by letter......they will try to claim that they are a 'telephone-based Company'.....this is rubbish!
Download from www.oft.gov the Guidelines on Debt Collection, this sets out how you can expect to be treated. It also lets you know which Rule sthey break ( most of them )....'borrow more to repay us' is a favourite!!

They are a one-trick pony! Threat, threat, threat.

Have a look at First Credit Debt Collection :) thread from Debtman2007.

Yes, they are a nightmare.....they mostly end up accepting what is offered, grudgingly, especially if CCCS ( e.g ) get involved.

DO NOT TALK TO THEM ON THE PHONE
    :D:D stay wonky :D:D

Me again. Mum22, make sure that the Loan wasn't 'front-loaded'. if it was, then the interest loaded should have been refunded to the Account as if it was an early repayment situation before it went for collection.
As you are ex-Bank you'll know what I mean.
You may need to do a Subject Access Request under the Data Protection Act ( fee £10 ) to find this out.
Having said that if you are making a request for the CCA then a Full Statement is part of that.

DO NOT SIGN ANYTHING, NOT EVEN A LETTER!

I've had fun with 1st Credit in the past and they've left me alone for the last few months and accepted my repayments but it took 6 months of threats and going in circles with them. I spouted all the rules of the debt collection guidelines that they were breaking during one call and said that I was reporting them. The girl on the other end (who sounded about 5, and had real attitude!) put the phone down on me which I thought was quite rude without saying goodbye!!!
Debt 30k in 2008.:o Cleared all my debt in 2013 and loving being debt free :)
    Mortgage free since 2014 :)
  • Thank you for everyones help.
The loan balance before it left Sainsburys was £19341 after paying them for ages it was £4500 more than when we took the loan out so i will send them SAR request with the £10. I have warned my husand to not sign A THING.
I am sure the interest has been front loaded. So they have sold the debt on with the loaded interest.

That's ok - they can read till they turn blue... so long as they don't follow the guidelines and can't produce the right paperwork then they haven't got a log to stand on :)
