You would think if they read the forums that they would "wise up" and realise that we are not stupid and know what they are up to and have got them sussed, but not sure they are bright enough to see sense. Hi i recieved an answer back from First Credit, the letter went word for word as follows, can someone please tell me what they think it means.
Dear Sir/Madam,
We refer to your recent communication requesting a copy of the relevant agreement.
The document you have requested is retained by our client. We will therefore advise them of your request and arrange for the document to be sent to you as soon as possible.
Should your request also include the below documents,please be advised of the following:
Deed of assignment-we refer you to sectin 136 of the law of property act 1925 which provides that the debtor is notified of the assignment of the debt in writing and not a copy of the deed itself.
Copy sttements - there is a charge of 10.00 for this information.
On reciept of the copy agreement we would expect you to contact this office immediately to arrange settlement.
Please call the office if you wish to discuss this matter.
I sent a request for CCA which they recieved on tuesday so they have acted quickly but i have no idea what they are actually saying.0 -
There is NOT a charge of £10 for Copy Statements...they should be provided along with the CCA.
£10 charge would be for Subject Accesss Request underthe Data Protection Act....i.e copies of all the Personal Information held about you.
( You had the standard letter there! )

And you are not askig for a copy statement, you are asking for a current statement of the account as you are entitled to do under the law.If you've have not made a mistake, you've made nothing0

I have also sent a cheque and a SAR request.
What are they saying regarding the CCA?
I also recieved copy of the client import note which has a lot of things on it i do not understand things like
client
prod desc
load balance
load date
write off balance
customer id
residency
address
land reg
joint account flag
third party strategy.
next to the headers are all my husbands details address etc and the date the debt transferred to First Credit.
What do you think will happen next?
Why have they sent me this?
Although it gives a lot of information it tells me nothing i do not already know,
and the balance of my loan is one amount on the 08/01/2008 and the last statement we recieved on the 10th Jan was for 1000 more, the date First Credit bought the debt was 12/08.
I am really sorry to confuse you but this info is so hard to understand.
I think this is a current statement of account from what i can make out but the amount has gone up a thousand pounds in 30 days, that makes me scream...0 -

That means they didn't bother to acquire a copy when they bought the debt and have had to write to the original creditor who will probably throw their request in the bin.

Remember the debt is unenforceable until they produce a copy.
You should refuse to enter into verbal discussions with them. Remember there's a sample letter on telephone harassment I linked to earlier.0 -
Thanks i will get the sample letter ready to go.
They are phoning quite a lot both mobile and home and he has even got text.
Under any circumstances we will not be talking to them.

Just to clarify...
First Credit Management (Evesham) and 1st credit (reigate) are separate and different organisations.
Why they continue to use similar names baffles me.
Both are CSA members who say they abide by OFT Guidelines!!!0 -
hi, not much of an update really, my cheques of £1 for the CCA and £10 for the SAR have both been cashed but heard not a thing back.
I will start to send out the follow up letters next week.
Totally quiet from their end we have not heard a thing.
Must say its lovely and peaceful here. Yes its 1st credit reigate i am dealing with.0
