If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

I called the CCCS and they advised me to call the Financial Ombudsman.
They have now contacted the Halifax on my behalf re my complaint and were extremely helpful
Will update as soon as hear anything0 -

Watching his with interest and concerned about the bad advice being given in certain cases here.
There are several account types which do not have interest and charges frozen despite a default or CCJ being issued, could this be the case? Has it even been considered?
I see this as complete folly to advise someone what to do or what not to do when dealing with a case which could end up in a criminal prosecution should the original lender decide to pursue it in that manner. There is an increasing number of lenders pressing for and gaining fraud prosecutions against borrowers where they can prove that the debtor has shown no intention of paying back, or has made little attempt to deal with the items in question.
The courts have started to take a very dim view of such actions as it's this type of behaviour which is slowly bring the country to it's knees. My view is that some of the people here (not all) should be ashamed of their actions.
It's cringeworthy to think that you could be setting someone up with a criminal record or even worse, sending them to jail for nothing more than a lack of knowledge.
I really hope you guys get your facts exactly right for the laws both north and south of the border as they are different.
On another note........someone should check exactly who the CCCS are and who runs them. Charity my rear end!
They are run and paid by the banks and building societies of this country to ensure pro-rata distribution of funds. They may not be around much longer as the financial institutions are getting fed up with the kind of advice they are dishing out.0 -

Whilst it is, indeed, true that CCCS, as other charities, recieve some funding from Financial Institutions, they are obliged to, and do, act totally independently of any organisation that may, or may not, donate funds to them. They are a Debt Counselling Charity, in the same way as National Debtline, Christians against Poverty and The CAB, all of whom are fully endorsed by both Martin Lewis (Owner of this website) and by the overwhelming majority of posters on this forum.
Indeed, your own statement that 'the financial institutions are getting fed up with the kind of advice that CCCS are dishing out' only serves to reinforce the 'independence' of CCCS.
The 'advice' given out by most posters on this forum, is based, in the main, on personal experience. It can not be wrong to point a poster in the direction of either a professional, free debt counselling charity, as opposed to a profit motivated fee charing company, or to point out where that poster may find protection in the Law of the Land - that is what this forum is all about.I am NOT, nor do I profess to be, a Qualified Debt Adviser. They did the same to me as I had a websaver account, last year they took the £30 payment by direct debit as normal but also took another £30 from my websavings account, when I asked why - they simply said my account would be paid off quicker. They refused to refund the duplicate payment, I was too scared at the time to argue. However from this site I now find they have transferred my account to Hillesden Securities/DLC without telling me first so are in breach of Section 40 of the Administration Justice Act ! I will be writing to them today.0

Hi Folks
Finally getting somewhere. After complaining to the Financial Ombudsman I recieved a letter from the Halifax this week apologising for being mis-sold PPI. This wasnt actually my original complaint. However they have agreed to pay this back within a month without admission of any error on their part!!! but cant quote me a figure on it as its 'dealt with by another department'.
I managed to get whoever signed the letter to call me back after ringing his direct number and being shoved around the houses for an hour.
When I explained that my complaint was that I have overpaid on my original loan he said he would pass it on to another department who would be in touch by the end of the week. Yeah right pull the other one!!!
Wonder how much I will get back for the ppi?

Recieved letter from Halifax yesterday
Overpaid premiums plus interest £1355:beer:
Rang them to ensure they have closed the account with Blair Oliver and Scott and was informed that they are also refunding PPI to the tune of £284:j
Only one snag, they had managed to send the cheque for that to an address I lived at 5 years ago:rolleyes:
New cheques on the way, and I should receive them within 14 days.
If I hadnt queried this whole !!!! up in the 1st place BOS would still be taking £50 a month from me...scarey.
