Can anyone clarify something for a newbie?

I heard from a co-worker that once your account is debited (as mine was, for one of these wardrobes) the contract between debenhams and myself is legally binding? Surely if this is the case they are obliged to supply the goods or be obligated to supply an alternate product of equal value?

Apparently the person who advised me on this bought something from LXdirect which was shown in stock in error and he argued that the company had entered into a legally binding contract to supply the said goods. They agreed to send him a similar (slightly more expensive) item instead?

Let me apologise in advance if I am totally in the wrong or have wasted anyones time. Just thought I would pass on something that I heard!

You are right. Legally once they debit your account then the contract is usually binding. However they often have clauses in their terms and conditions to protect them from this too. We've seen in the past with those Dell 27" LCD TV's - everyone's account was debited but only a handful of people got their TV's as Dell ended up selling out.

In the end they offered everyone £70 off anything on the site. Many people are still chasing this up as we speak and not getting very far. It even stated in Dell's contract that once payment had been accepted, the contract was binding. Their argument is we've sold out and cannot physically make any more as it was an "end of line" product.

Some people got away with using the "Loss of Bargain" term where people were able to purchase the exact same TV from somewhere else at full price, and got Dell to make up the difference. Lucky sods...

I too had my Debenhams wardrobe order cancelled and my account had been debited too. Whether Debenhams offer a better product for the same price remains to be seen, but unfortunately I doubt it. Maybe a few people can try the legal approach and see what happens...?

I had a letter today confirming delivery by 15th Feb. Great stuff. Only.... they've refunded my money already and sent me an out of stock letter earlier this week :S. Will be interesting to see what happens.

    Hi

I have called them to check my order and guess what they have just cancelled it today and are going to refund me. I am really annoyed as i called them last week and they confirmed everything was fine( i ordered on the sunday) They should not be allowed to get away with this and i urge everyone to write a letter of complaint as otherwise they will just carry on messing people around. Sorry rant over.

i have looked at the debenham's customer service page, in clause 2.5 they say , more or less. the contract does not take place till the goods have been shipped and the invoice has been sent, and they can debit your account, well i have had my invoice several days before they debited my account, and as i cant physically see when they ship it, i think they have a contract. i havent yet heard from them yet by letter or email. but when i do i will argue this case
