I used to be firmly of the opinion that people should pay back whatever they spent then close the account or even better find out if an agreement is legal as soon as they recieve it, rather than doing so years later when they spent all the credit & got cold feet but the more i have looked into the possibility that many people could well be struggling to pay a debt that might not be legally enforcable, the more i am beginning to understand why so many people are looking into contesting thier agreement HOWEVER i am not at all confident that many people will be successful from what i have seen regarding the subject on MSE because the amount of people asking for advice on challenging a possibly unenforcable agreement far outweighs the amount of people who come back to tell us they won & got thier debt wiped out.
That i have to say speaks volumes about just how hard it must be to even get past the first hurdle. You kind of have to ask why we hear of hardly anyone who has taken the challenge up and won. If it is that common for agreements to be unlawful and thus unenforcable then how come we barely ever read any success storys compared to the reams & reams of threads asking about wiping out debts?
There does seem to be a lot of grey areas in this technicality that has rendered some agreements unenforcable for the successful results to be so disproportionate in comparison to the amount of people who want to challenge it
Its a relatively new concept for the public and its not long been in the "public domain" - it takes (can do) up to 9 months for a case to be settled. Come back in 9 months time and see if there are more success stories.
I personally think that ppl that are successful are less likely to be on a site like this - this is a site where ppl first come to find out about money saving tips etc.... if you're succesfully challenging your agreement, then you'd have it all in hand and no reason to come and take part in these forums.
I've been successful with it, bank charges, PPI and CC write off.
It's human nature, no one wants to really hear about other ppl's success's they wanna hear about ppl that struggle and talk about problems and give advice. Forums turn normal ppl into Gods and the advice that pours out of some of these threads is "priceless".

I totally agree, with one caviat. Find a professional company that does not charge you a fee at the front and does not deduct a chunk from any money that you may be due back. There are just one or two companies that offer a totally free service.I am a former Broker, former IFA and former compliance officer, for my sins.

Yes my advisor friend also said it's relatively new and there are claims going on so yes in time we will hear of more success's, paying a firm to do it does sound better as they're law professionals but to anyone who wants to try the diy approach, good luck0 -

I imagine that the "free" service ones are only helping ppl with claim of 5k or more. Under 5k, law firms are unable to claim expenses agains the losing side.
I don't think its unreasonable to pay a decent form some money to make sure you claim is goign through well. Most solicitiors will not take on a individual case as it's not worth it for them (no expenses unless its a lot) and not worth it for the client cos they'd have too many fees to pay.
I wrote off 6k and paid a few hundred quid. I have no ill feeling for that cos I knew I would not have had the knowledge to deal with it myself.
I dont wanna run the risk of finding myself being countersued and liable for costs if I make a mistake.0 -

Guide people if you are the knowledgeable one - it's easy to knock someone, it takes a man to help someone and be humble.
