Other party's car insurance is stalling!

Hi

I wonder could anyone give me a bit of advice. I had a car accident back at the beginning of October which was the other person's fault - I was sitting at a petrol station when someone drove in and then reversed into me. Their insurance assessor came out eventually to look at my car and decided that my car wasn't worth the cost of the damage (I was quoted £1,565) and offered me £1,265. As we were thinking of replacing the car I decided to accept. However, every time I call the insurance company they have got an excuse and as yet I haven't received anything.

Does anyone know who I can complain to?

Any advice greatly welcomed.

    when did the assessor come round??? which insurance company is it??? what excuses are they using??

    There is certain procedures to follow, such as MIAFTR, dvla etc.

    If you want to complain, best to write to the insurance company at this time.

    Think your best bet is pester power, just ring everyday looking for updates, ask to speak to the team leader etc. Make a nuisance and they will look to 'get rid' of you quicker i reckon.

    I rang again a couple of minutes ago. They now said they can't really give me any info. as I am third party and have given me their solicitors number! They are on voicemail.

    What agreement do you have from them.
    Do you have anything in writing to indicate that they have accepted liability or an offer in writing?

    If you do then I would write to them by recorded delivery (70p?) and keep the ornage receipt.
    Tell them that if they do not send your cheque within 15 working days then you will pursue the matter within the small claims track of the county court.

    If you don't have anything in writing then this may not be a appropriate way to go, so please can you say what you do actually have that you can prove (in email, writing etc.).

    This seems very strange indeed. Which insurance company is it? I know another poster has already asked.

    So presumably you don't have fully comp insurance?
    Did you pay for the additional legal cover?

    The insurance company is NFU. I had third party insurance cover and as it was the other person's fault I went through their insurance company via a claims handler at the garage where I got the quote for repairs.

  • Ah, I see now. It is not NFU that have assessed your car by the sounds of it.

    Is it the claims management company you have been trying to call?

    I called the assessors who work for NFU - they told me they sent the report over to NFU on 22nd December and they very kindly gave me NFU contact details. I then rang NFU and asked what was happening. They said they didn't receive the report and that their solicitors were dealing with it. They gave me the solicitor's number but it is on voicemail.

    Your claims handler/manager should be chasing this for you.
    Have they given you a hire car?

    Chase the claims management comapny.
    If you have a hire car then what's the desperate urgency?
    Car prices are not sky rocketing (far from it) so you won't be losing out by having to wait a week or two.
    These things will take a few weeks to be agreed and cheques raised.
    Are you experiencing major inconvenvience problems? You shouldn't be if you have a replacement car in the meantime.
    If anything car prices are falling whilst you are waiting.
