As for purchase of flat, I did not purchase it, he did and its all under his name.

That's true - and it probably negates any silly idea he has about the flat being left for the children's future.             you won't get a 2 bed flat from the council. probably a one-bed, but to be honest that is highly unlikely as the council will take in to consideration your assets before rehoming you, what is more likely is that you will rent in the private sector with your housing benefit being paid to your landlord.

            You wont get offered a flat straight away as you WILL have to go into a hostel until a council house comes up.
As you both are joint owners then really if you move you are MAKING YOURSELF HOMELESS and by doing that you wont get offered anything YET.
If I remember from your DH post your house is up for sale and the concil WONT do anything until YOUR HOUSE IS SOLD then you will be housed a SOME POINT.
I know what Im taking about as 2yrs ago my hubby and I did break up and I went to the council looking for housing and this is what they told me.
So the best thing to do is PUT UP WITH IT OR BUY HIM OUT, If he is nasty then report it AND YOU MIGHT GET SOMEWHERE BUT I DOUDT IT.

            Wow, £176,000 for a right to buy council flat sounds pretty steep.
Did not think right to buys were in that price range.0 - 
            susan - it depends on the type of property - and i think the maximum discount is different in each area (not sure about this last point, but I think the maximum discount is now about £20k)
a 1 bed council flat in islington could be valued at say £200,000, and if the maximum discount was about £20k, then that would be about right.
if you happen to live in a terraced, Georgian council flat in islington, valued at £300,00 - and the maximum discount is £20k - then you would need to be a lawyer or doctor to afford a flat under the RTB scheme.
EDIT: just found this on Direct Gov website...The amount of discount depends on how long you have been a tenant. For example if you have lived in a house for five years the discount is 35 per cent of the market value of your house. If you have lived in a house for 20 years the discount is 50 per cent.
However, the discount is limited to the maximum amount available for your area. The maximum discount ranges from £16,000 to £38,000 for both flats and houses depending on where you live. To find out about the discount available contact your landlord.
now that house prices are tumbling it might make the RTB scheme workable again.0
