Unfortunately as you have a car, they might view it that you would be able to take your OH or he use your car. Cars are a very sticky area when it comes to BR - some OR's have quite a high exemption level, some will take car worth only £200 simply so they can lower your expenditure on your SOA in the hopes of getting a IPA from you.Get free advice before embarking on bankruptcy: CCCS 0800 138 1111 National Debtline 0808 808 4000

Just to say daughter has just rung CCC's with a view to getting help to do a DRO. She has been told by the advisor that she can not appy for a DRO beacuse she has a car valued at over £300(no assets allowed over £300) but less than £1,000.
So she has been told to go bc and to tell all(4) creditors she is going bc:eek: .She is unemployed and pregnant so it will take her ages to save the £350 needed.

Just checked the Q&A on the website, doesn't mention vehicles, just that gross assets can't be more than £300:
http://www.insolvency.gov.uk/insolvencyprofessionandlegislation/DebtRelief.htm
There's some info in the draft rules, mainly section 4a.12, am assuming the prescribed amount is the £300 asset, but it's not that clear
Particular descriptions of property to be excluded for the purpose of determining the value of a person’s property
4A.12.—(1) For the purposes of Rule 4A.11, the official receiver may disregard—
(a) subject to paragraph (2), a single domestic motor vehicle belonging to or vested in the debtor provided that—
(i) it has been especially adapted for use by him or her because he or she has a physical impairment that has a substantial and long-term adverse effect on his or her ability to carry out normal day-to-day activities; or
(ii) the maximum potential realisable value of the vehicle is less than the prescribed amount;0 -
