  • I think so. OH has been advised to transfer the banger I brought him into my name. Only worth £300 but he cant say he needs it for work.

    Latest update from CAB. Yesterday we received information that a commencement order was signed last week in relation to DROs with new legislation ready to go live on 6th April 2009.

    As demonstrated on here there are likely to be issues that need further clarification which is usually the case with anything new.

    A number of our advisers at NEDCAB have similar concerns and are in the process of speaking to the relevant bodies. We hope to post further on these.

    Anyway, it looks like the green light is on and lets hope this welcome new remedy can make a difference for some people as we believe it will.

    CCCS advided OH just have to wait and see. I finance everything except petrol on it so dont want to see it go.

    Ta for the bump. Read the whole thread now. Yes, nice in theory but still *incredibly* hazy and last-minute. And the disposable income restriction is draconian. What happens if you get a payrise? I'm still trying to see an advantage from the user end, other than cost and (alleged) simplicity.

    Your OH shouldn't transfer any assets before going BR or DRO as it is frowned upon. If you bought the car do you have proof of this such as a money trail? The car 'belongs' to you anyway but any messing about now could cause you trouble.

  • I paid cash but can show the cash withdrawal on a statement. Also have paid / pay for all repairs insurance etc. The only thing is that I put the car in his name. I have a company car so I sold my old car to buy the banger and get some more cash for debt busting. Id be annoyed if the car goes :mad:.

    You might be able to show that to all intents and purposes the car is yours, but you should be prepared to lose it unfortunately.

  • For BR I know you can keep a low value car if you can show its needed. OH is partially disabled and has appointments 23 miles away. Public transport is a nightmare an usually means I need time off to get the kids from school.
