Simple thing to me is that you are doing a DRO because you have a surplus of less than £50 a month, so in reality that is the most you can afford to pay her. Do you have a surplus on your income and expenditure form on your DRO? if yes, then that is all you can offer. If the surplus is £0 you can only offer her £1 a month. But you cannot make any payments until your DRO has finished it's moratorium period, otherwise you could be deemed to be making preferential payments to a creditor (mother in law).

Alternatively if you have no contract between you tell her do one. You're in no position to repay any debts, hence the DRO.

For a start, your husband needs to stop shifting his debt around. all he is doing by borrowing to repay is increasing payments and the total he amounts he owes. I dread to think how much extra he will repay in interest to what he originally owed.

As already mentioned, maybe you need to look at a DMP for the two of you, include all debts, and stop using all credit!!! learn to live off the budget provided for you, and you will eventually become debt free!

I have posted my SOA below, I have included my income and expenditure only - that is only the money being paid into my account and the bills etc coming out of my account. We do get housing benefit in joint names, but this goes into my husbands account and my husband pays the remainder of the rent and council tax from his account, will this effect it? All other household expenditure such as groceries comes out of hubbies account.

Overdraft cost.?

I take it that will be a debt you want to include in the DRO?. If so and you add that to the £300 CC Payments then subtract the combined amount i make it £448 which means based on that I/E form you don't meet the criteria.

(If my assumption is correct of course).

I have quite alot of debt (4000) it may not be as much as some peoples but still it worries me, it came from several loans taken out when I was with my ex partner..
Anyway Last year my dad brought me a car, it was about 5k i think, as my old one was unreliable and falling to pieces and obviously I was unable to afford a new one.
Now id love to apply for a DRO as my debts really worry me, but I know the car would be an issue. I know its a bit naughty but would it work if I put the car into my dads name, seeing as he payed for it anyway??
I dont know if they check such things.

I dont know if they check such things.

don't transfer it anywhere! just keep proof that your father bought the vehicle and the DRO would become an option to consider again.

Dont include any payments to your debts in your SOA. Does your OH pay for ALL the food? and what about clothing for yourself?

With your income only being from pension and tax credits/child benefit it should be possible to draw up a budget for a DRO. If you get housing benefit im guessing your OH doesnt earn a massive wage?

We can say yes or no as much as we like on here, but the best thing you can do is contact someone like NDL or CCCS and get some help in creating the budget with them, and they will then point you in the right direction for you, and if a DRO is the best option, they will do that for you
