    Hi

    My advice to you at the end of March was to find the Intermediary who is going to act for you. WBA suggested CCCS or National Debtline if your local CAB was not helpful. The advice still stands - and Broken Spirit has made the same suggestion! If you had an intermediary they would now be advising you on the bailiff issue.

    You are now further down the line and need the DROs more urgently, so:

    1. It sounds like everything the bailiff told you is incorrect (surprise!). You do not (must not) grant them access to levy on your goods. Also, hide the cars so they cannot levy on them. They cannot make you sign anything, and you should not (must not) do so. They will not remove anything - they are just putting pressure on you. Nothing has to be cleared in 6 months.

    2. If you give them a WPA on your goods, the goods become the bailiff's and they are not protected by the DRO - meaning in theory that you should then make payments to the bailiff to keep them. It's a can of worms and may give the council evidence to challenge the whole DRO (asset value, surplus income) so don't go there.

    3. You will need to find £90 x 2 for your DROs so that is a better use of your money.

    4. The delaying factor is often getting the Experian credit report - we still have to do it by post and it takes three weeks. I know Experian are starting to roll out a faster method that some bureaux will now have but, even so, the fastest way is for you to get your own reports.

    As for Friday - the best thing is to go out and take both cars. If the bailiffs do catch you in, keep windows closed and doors locked. If you must talk to them, do it through letterbox or upstairs bedroom window. Please don't say that you're going for a DRO - that will just cause them to make more of an effort to levy.

    I did hear an ex-bailiff advise a client how to deal with bailiffs - he said just laugh at them through the f.....ing window! That's a sort of summary.

    ive today been the the CAB. i saw a man who after giving me a grilling and telling me i could go to prison decided to help me.

    He also advised me to stay out when the bailliffs are due and not to sign a WPO. we have to go back on monday and see someone who is better informed to deal with our situation. he didnt say if a DRO was possible or that we go bankrupt, as far as im aware they just want to help get the bailiffs off our backs.

    i have never in my life felt this scared about something, ive this huge black cloud over me and the thought of going to bed tonight and facing it all over again fills me with utter dread.

    please someone tell me there is a light at the end of all this :(

    I think that the CT bailliff issue is at the top of your list of priorities right now. Follow the advice Fatbelly gave u yesterday. When u attend your appointment on monday u will be able 2 explain your circumstances in full & tell the advisor you'd also like advice on dealing with your other debts. Make sure u take all relevant paperwork, proof of income/expenditure/creditors etc (use this weekend 2 prepare) They're there 2 help u, but if u don't tell them the full extent of your debt,they won't be able 2 offer u the relevant advice. It's hard......... I know, but providing u deal with this now whilst the help is available, there is light at the end :)

    hi guys,
    After having to wait for 4 weeks for someone to come back to me on my dro application at the CAB in strand, ive recieved a call from a guy who says his had a look and i have excess income so disposable income of £96. Basically his worked out my benefits/wages at Xx52/12.

    He was really keen on me not doing this and kept advising me to do bancruptcy, which i told i do not wont to do.

    After insisting i want to come in and talk face to face about the figures he arranged an appointment but was clearly unhappy about it.

    i have some statue barred debts from about 10 years which he said even if my dro gets put through i need written confirmation from the bank that i no longer hold the debt from them, but the bank dont have any information about me.

    This guy is a real pain, i know i can shuffle my expenditure a bit and reach the £50 max but he was not keen.

    Should i go to the appointment or can i just ask back for all my documents and go to someone else?


    Im really frustrated now.

    i agree with Scarlet on putting your SOA on here, there are a few of us that will have a look and let you know our thoughts. It is generally the consensus that people on benefits will get their surplus below £50.

    Statute barred debts must be included in the DRO, the statute barred bit only means they cannot persue through the county court. as long as you know the creditor name and balance it should be enough to add it to your forms.

    If CAB aren't ticking the right boxes in serving you, try NDL or CCCS instead?

    As you know all my benefits/salary are worked out as (Xx52/12). so would taht not mean my expenses mainly the rent and council tax should be sumed up in the same way?

    In regards to the old 10 year debt even though ive put company name and rough estimate his asking for refrence o letter which bank can not provide as i called them.

    A few things stick out to me.. however I don't have the trigger figures to hand so others can no doubt clarify further.
    Who's name is the car in?
    Is your council tax worked out over 12 months? Or is it 10 months?
    Your phone/mobile costs are high
    Clothing is low for a family of 3.
    Car costs seem high, especially insurance etc
    Is your social fund loan being deducted from benefits? If so are you benefits figures taking that into account?

    What are the figures that CCCS used? Could it be that you exceeded some trigger figures and your expenditure, when cut down to be in line with them, was then over the £50?

    He told me his made a draft online so if i decide not to do it with them would i be able to make a new dro with a new compay and will he give all my documents back or is he going to be a pain?

    Each company and each advisor may account for your expenditure differently, so it's worth getting other opinions. They should send your documents back as soon as you tell them you don't want to go ahead with them, have you got a copy of your credit report? If so that'll really speed things up.
