    The amount varies on where you live. If you are a significant amount under your lha with your rent, it is unlikely to affect you, but if you are paying more for rent then your lha is, then it will as the lha is going down..

    Try the entitled to website and do a benefits check it should come up with the new LHA rates for your area...

    The person with the debts- 9k work is a married stay at home mum . The debts predate the marriage. Her only income is child benefit and child tax credit,( JOINT CLAIM) which is used towards the household expenses

    Her husband obviously pays the majority of the bills as he is the one who is working.

    How do they work out the £50 excess amount in this sort of case?

    That might be how you'd do it ;) I would look at the split of the income, and then split the expenditure fairly :)

    As a DRO is an individual remedy, the income of the applicant is used (not the household income) and then their share of the expenses.

    I would discuss this with the applicant before advising on their options.

    I am able to apply for a debt releif order in april as pensions will now not exclude me. please can someone tell me what paperwork i will need? i want to get everything organised so that i can apply on the day of the rule change. also can anyone tell me if i will have to include me student overdraft with santander? its my current account and i have a £1000 overdraft on it which i'm into, but i dont really want this written off as id like to stay with santander. would i have to include this or could i choose not to?

    you have to include all debts, if a debt comes to light that you have not included your dro could be revoked.

    You need all evidence of income..eg tax credits award, wage slips, housing benefit letter etc.

    Credit report

    List of outgoings

    log book for car..(make sure under 1k)

    also all account numbers for dreditors because the credit report doesnt show it.

    the dro is but income and expenditure hen you are part of a couple is hard to determine....when my dro was done they added all expenditures then divided by 2 and just used my income.
  • ok thanks for the reply. does that mean that santander will close my account and the overdraft will be written off with the debt releif order? will i have to get another bank account?
