If you were seen under legal aid and they have closed your case they won't be able to open a new case fr 6 months, but for one off advice you may as well ask one of us, or contact the DRO unit directly.
and thanks! lol
Thank God i asked, i had convinced myself i had to keep paying the £1.Thank you immoral_angeluk,thank you so much for posting i could have really got myself into a right old mess!!!!!!!!!!!!:kisses3::happyhear:happylove:A
As for the legal aid part yes i was using legal aid to pay the solicitor and i didnt even know of the 6 months thing, nobody told me about that! Good thing i didnt contact them, apparently they charge £4 per phone call plus what ever they did i now know it would have been charged directly to me if that 6months rule applied, thank you again for the info!!!!
Lol if you ever need somewhere to stay, my door will always be open immoral_angeluk!!!!:D

Personally i would phone them up and give them your DRO number. If you have tried this i would then send a copy to the head office along with a covering letter just saying you are under a DRO.
Ultimately and do not forget this. If you are now under a DRO and you have included the debt to Very in that DRO. There is nothing they can do to you. So whatever threatening letters come your way do not fret as they can do nothing.0 -

Orville is 100% right, I am not a fan of phone calls so if it were me i'd send a letter stating that they are in breach of the DRO by harrassing you, and include a photocopy of your DRO approval...
Or phone them if it's easier... but they may ask for a photocopy of the DRO approval...0 -
thanks for that .i was a bit confused as i thought once the debt has been dro'ed it cannot be passed on to a dca to pursue i thought it was against the law? the debt i was on about was included in the dro. so why are they passing it on to a dca?0

It maybe a mixup between departments (one receiving it and not passing it onto another). Or it maybe that the dca might be an inhouse dca and therefore they may not have been notified either. I had a call myself from mercers i think it was (the inhouse dca for barclays), i told them of my dro and gave them my number and i have to admit i haven't heard a word since. As i said earlier though don't worry as they can't do a thing if the debt was included in the DRO:D.0 -
Hi, please be gentle.. this is my first post here...
I am currently seeking advice regarding my financial crisis. I have an appointment with CCCS at 9am on Monday (already had preliminary phone call with them)... I'm feeling so anxious about sorting this mess out, that Monday seems forever away!!!!
I am wondering whether I would qualify for a DRO?
Criteria:
You must be unable to pay your debts. Unfortunately, yes
You must owe less than £15,000. A little over £11,000 (inc car HP)
You can own a car to the value of £1000 but the total value of other assets must not exceed £300. ??? *see below*
After taking away tax, national insurance contributions and normal household expenses, your disposable income must be no more than £50 a month. Definately
You must be domiciled (living) in England or Wales, or at some time in the last 3 years have been living or carrying on business in England or Wales. Yes
You must not have been subject to another DRO within the last 6 years. No
You must not be involved in another formal insolvency procedure at the time you apply. No
*So, as you can see.. I do fulfill most of the criteria.. BUT I have a HP agreement for my car (have just over £4000 remaining to pay & i'm £790 in default!). I would voluntarily hand over the car if it meant I could start sorting out my problems
Does anyone out there have any ideas/advice?
I would just love to sleep at night....
and not dread my phone ringing...
Thanks in advance

I think and only think the crucial question is What is the value of the car..? If it is over 1k in poor condition (use parkers guide) then you don't meet the criteria.0 -

Immoral/Fatbelly or wba31, this will be my revised SOA when i move back to my parents. I am not including the buisness and expences yet untill i am actually up there and have a start date. If i am informing them of a change of circumstances can this be done over the phone or do they send me paperwork to fill out..? Will i need to send them any paperwork(bank statements/origional debt statements) or does the paperwork i first provided when i got my origional DRO still stand..?0
