    Immoral_angel, I have a question about a creditor that's still contacting me regarding my DRO:

    My phone contract with Orange was passed to the Moorcroft Group and they're persistently ringing me despite me telling them I'm subject to a DRO. I've advised all my other creditors and given them the DRO reference and every single one has said "not a problem" and were rather polite about it. Moorcroft are pushy, incredibly rude (probably because they aren't getting their money) and won't accept the reference number. They keep telling me I've got to send them a copy or they'll file a claim against me in court.

    Can they actually do this or are they just trying it on for the sake of it? Shall I bother sending them a copy to shut them up or ignore them? :cool:
  • Hi guys, I have a debts under 15k but have a car on finance which pays up at the end of this year, some intermediarys are saying that I have to include this and others are saying no its not as it is a secure debt, and with this included it takes my debt to over 15k, i dont work as was made redundant and have previosuly been in a DMP but it was pointless as they were taking more for them selves as to what they were actually giving my creditors so came out of it, have been speaking with creditors and can only afford to pay 1 pound a month as no income, just wanted to know if anyone has any views on why some are saying i have to include my car finance and others say I dont.......

    Hi

    Your 'morotorium period' should have ended in December and so you are now discharged from liability for the listed debts. Your record stays on the IS website for three months so now is the time to print out your record and send a copy to anyone who contacts you in the future about those debts.

    They cannot file for a CCJ now the DRO is in place, but sending them a photocopy of your DRO approval will certainly shut them up

    The guidance notes state that HP is not an excluded debt and will contribute to the £15k level. Obviously the vehicle is not declared as an asset as it belongs to the HP company until the final payment has been made.

    If a HP debt is included in a DRO (which it must be) the HP payments are not to be continued.

    Who has told you that this is a secured debt? They should know (or at least look it up in the guidance notes) and see that it should be included.

    You mention that you finish paying for the car this year, what car is it? It will then be an asset, and if worth more than £1000 will mean you are still ineligible for the DRO.

    Is 'the other place' somewhere where you could get advice and where there is an Approved Intermediary?

    Did you ask why you were being referred? There are lots of possible reasons - your adviser was not a debt specialist, he/she was a specialist but not an Intermediary, he/she was an intermediary but you did not meet their eligibility criteria,...

    There was a list, which I'll try to find, of CABs with AIs, but it may well be out of date.

    Quick question:

    I got a DRO in 2009 (August). It was accepted and finalised and passed.

    I am just wondering, I know it affects my credit rating and means no new debts or loans etc for a few years (8? 10?) but will it affect getting a mobile phone contract?
