  • a couple of thou I think - have to get a proper figure form them but definitely over the £300 threshold - was years ago and he contracted out of SERPs so a bit went in and with it growing (a bit) - just seems unfair to folk who did as they were told and took out pensions and now are nobbled because of it and tbh he is now a carer on state benefits and looks like will be for the foreseeable future so will lose it all in the income support mix when he can finally access it - if theres still income support in 10 yrs ;)

    Has he looked at bankruptcy as an alternative?

    Hmmm won't even consider it lol - god knows why as I can't see much difference except the fee - guess hes old fashioned and still sees the percieved stigma that used to go with it still

    My husband has a DRO from July 2010, and his car was listed as an asset under 1k. We are now looking to sell his car because we would like to use the money to move house. Is this allowed while he's got a DRO, and does he have to inform the OR?

    It won't make a difference. So long as you don't end up with over £300 in savings after the house move then I wouldn't worry about it. You will however have to inform the OR you've moved as you need to be contactable during the DRO.

  • Following my DRO being granted, I have received a letter from Egg stating that:

    "We will be seeking payment from you for the full amount that you owe us under this agreement as at the date of your Bankruptcy / Sequestration and we will be negotiating with the Official Receiver for payment of this sum."

    Should I be concerned, or do anything, or is this normal and I should ignore it? I suspect the latter but someone else's opinion would be much appreciated.

    Also, Santander are still relentless with the phone calls, even though I have already spoken to them and given them the DRO number. I've also had a letter from them today asking me to pay my missed payment. It seems that either one department is not speaking to another, or they are just trying to ignore the DRO and get some more money out of me..? Again.. is this normal? I suppose I could try writing t them with my DRO details - is this allowed?

    Sounds like a standard letter regarding bankruptcy. In a DRO assets are not seized by the OR to be redistributed to creditors so they're not going to get anything out of contacting the OR.
    As for santander sometimes it can take a while for the OR to contact creditors, so I'd write to them and send a copy of the DRO report.

    But also feel free to quote from the official guidance:
    Payments to creditors

    If the Official Receiver approves the debtor’s application and a DRO is granted, all qualifying creditors scheduled in the DRO application will be contacted and notified that a DRO has been made. These creditors will also be informed that as a result of the DRO, the debts scheduled as owing to them are irrecoverable. As such, the debtor must not make any further payments to those creditors.

    If the debtor receives any requests for payment from creditors that are scheduled within the DRO during the period of the Order, the debtor should indicate that they are subject to a DRO, and as such creditors have no remedy in respect of these debts.

    If the nonsense continues, I would suggest a formal complaint to the creditor, requiring a final response within eight weeks. Then consider a formal complaint to the Financial Ombudsman Service.

    This is my first time posting but I read the forums very often and have gained lots of good advice including the advice in this thread.

    I am at my wits end and feel that applying for a DRO is my only way out but I am very worried and am unsure if I would be accepted.
    I live in a rented flat and own nothing of value.

    My debts amount to roughly 11.5k and I am unemployed and not claiming any benefits at the minute, this has all mounted up due to the past 2 years being extremely difficult in many ways. I have also been unable to pay any of my creditors for about 3 months.

    I live with my partner who is paying for everything at the moment, and there is little left over at the end of the month, when applying for my DRO, would my SOA contain his information only? This is the only part that is confusing me.

    Please help, I appreciate all advice given.
