I think it roughly takes around 2 months with the CCCS... You can help speed it up like get all your latest statements togther and when they send you a experian credit report sheet fill it out and send it 1st class recorded, i sent mine like that and got it back within a week. As for the rest i don't know as i have decided to go with the CAB as i got on very well with the rep i saw. I think it varies with different CAB offices depending on how busy they are. My advice ring or pop in.

My local CAB dont do them, apparently the nearest one that does is no anywhere near me!

Hi, apologies as I expect these questions have been asked many times before, but just to point me in the right direction on this board would be a great help, thanks.
1. I currently have a DRO, it went through on Sept 11th, so I assume that as of this Saturday I am no longer bankrupt. (wahoo!) I've been looking at a few things on the net about discharge and from what I understand I will be automatically discharged, therefore I won't get a discharge certificate but will have to apply for one instead. Is that correct? How do I go about getting the certificate?
2. When it says that I will be released from all the debts is that REALLY what it means? It just seems too good to be true that I won't owe anything. I'm half expecting a barrage of phone calls on Monday morning with them wanting their money back!
3. What about joint debts? The majority are my exes debts, but in joint names, so will those debts be wiped out entirely or will they just 'forget' about me?

Is that correct? How do I go about getting the certificate? You wont get a certificate from the IS. Print out a few copies of your entry on the IS website to keep as proof of your DRO. Your entry will drop of the website 3 months after the end of moroatorium.

Providing you have kept to the criteria of the DRO during the 12 months moratorium period, all debts listed will be cleared. Your credit file should show this, with your creditors marking each debt as satisified, however you may have to prompt them to do this...(see the sticky on credit file clear up on the main bankruptcy forum)
3. What about joint debts? The majority are my exes debts, but in joint names, so will those debts be wiped out entirely or will they just 'forget' about me?
If they were listed in your DRO, you will be cleared of the debt upon completion of the DRO, and the responsibility of the joint debt will go to your partner, unless s/he is bankrupt or in a DRO.

Hi all,
A bit of advice need please! I live with my partner and decided that after my maternity leave ended I would stay at home and look after our little one. This was a few months back and we are now struggling to live. The main reason is my debts. I owe around 6500 with monthly repayments for these around £350 a month! I feel so bad as it is all my fault that we are in this situation. So, as I dont earn anything I just recieve child benefit at £53 every 4 weeks would I be eligible for a DRO? The debts are all in my name. My partner does work (about 800 a month) and we recieve tax credits about £116 a week.
Any advice needed, also when filling in the cccs debt remedy do I put in any of my partners details?

Hi everyone.
I'm new here and hope you can help me. I've just heard about DRO's and i think i qualify. I have about £9000 of debt in the form of a bank loan, a credit card, a topshop card and 2 catalogues. I am a single parent with a 1 year old and as of next month i will be unemployed as i am leaving my part time job as my mum can no longer look after my baby and i cant afford child care even with extra help from tax credits i would really struggle. I live in rented accomadation, and have no assets only basic every day items in my house...also no savings.
I think i would recieve about £600 in tax credits, income support and child benefit once i am unemployed, but this figure could be lower.
I think my monthly bills would be;
Rent £50 (as HB would cover the rest)
Gas £40
Elect £30
M.Phone £20
Food £250
Tv Lic £12.36
Pet Food £20.00
Nappies £25.00
Clothes.. £80
Haircuts £10
Contents insurance £??? - looking into getting this.
Birthdays/emergencies £15
So i will be left with £48 i think each month...obviously once i have sorted contents insurance this will be less.... would it be acceptable...im not sure if ive missed anything off or if the amounts ive put are acceptable??
i would appreciate some advise if anybody can help please??

Yes, it looks that way.
Your intermediary will do the fine tuning. 'Clothes' looks high but you have nothing for travel or water.
There would be something wrong with the system if someone on income support did not qualify.0 -
You really need to do a proper budget planner. As fat has said, you have nothing for water etc and I see nothing for Things like broadband etc either.0

Got a phone call from the CAB today. She's putting my dro through next thursday...Fingers crossed it goes well..0

me and hubby have joint debts of approx £23,000 , we went to the CAB earlier today and she suggested DRO for hubby and BR for me.
his debts are approx £10,000 and mine are £16,000 so hubby can go for DRO but I can't, so how are joint debts worked out. ( yes I know £10,000 + £16,000 = £26 but within the above figures are two joint overdrafts alliance and leicester £474 and TSB £2717.
how are those treated, are they added to both out debts or split 50/50. I know we are jointly liable for the debts but surely they can't be included on both our list of debts? eg take TSB off mine then I'm below £15,000. CAB worker has included both overdrafts on both debt lists
last year hubby won a tribunal case and we paid off some of the lower debts off ( seemed like a good idea at the time) so after reading info on here we know that would go against hubby but he also has a pension as well so is that treated as an asset, we have a car worth approx £500
and what happens to a current bank account ( joint with Yorkshire Bank, no overdraft) would that be affected?
we currently pay creditors off at £1 month.

If you are both going to be insolvent, the joint debts will be wiped out with your hubbys DRO, and your bankruptcy.
However if only one of you were to enter insolvency proceedings, the responsibility of the joint debt will pass to the non insolvent partner, and s/he would have the responsibility of paying the FULL amount off, not just half of it.
