INSURE & GO - wriggling out of claims

hey there. was wondering if anyone else has had problems with Insure and Go.....
They are refusing my claim on the basis I left my bag "unattended"
Unattended - When you cannot see and are not close enough to your property or vehicle to prevent unauthorised interference or theft of your property or vehicle
I honestly answered their questions and said that the bag was not in my line of vision as I was trying to buy a tram ticket in Czech, which I have never done before!! even though the bag was next to me, but "slightly behind me" they are saying that I left the bag unattended.
Wondering if anyone has any advice for me?

Hmm, I think they are trying it on a bit to be honest.
There is an almost identical item of case law you can refer to when dealing with claims like this- Port-Rose v Phoenix Assurance (1983). This was where a lady had a bag of jewellery on top of a baggage trolley, turned around (never leaving it) and it was taken. In short, the insurers tried to decline the claim and lost in court.
Whilst it is for a very minor difference (the insurer was relying on the reasonable care clause), attendance and reasonable care and trying to say pretty much the same thing. It therefore gives an indication of how the FOS and courts would rule if it went to them- i.e. not with the insurer.
I would ask to make a formal complaint- they would then have to acknowledge this within 5 working days and have 8 weeks to provide a formal response, after which you can refer the matter to the FOS. I would emphasise the fact that there is an 'AND' in the policy, and whilst it may not have been in your eye line it was presumably within reach without having to move.0 -
We are having a nightmare with this company.
My son lost his Ds and 10 games when we went to Disney in October. He had it in the car and b4 we realised he no longer has it we were on the plane. I assumed it had fallen off his knee and would be in the footwell of the car however, on our arrival back to Liverpool carpark there was no sign of it. we asked the man in the carpark booth if it had been handed in and then we phone liverpool lost property first thing the next day, as we had landed really late. No luck so we filled a claim with insure & go. They sent a letter just b4 christmas to say that they needed further info as i did not have a police number within 24 hours of losing it and the email i sent was not suffice. ~we had no police number and they knew that in the original claim as we didn't go to police as it was lost instead of stolen....they say....as per their conditions. We have sent original receipts and everything...are they trying iy on because they know we have house insurance!! Any help greatly appreciated as my little boy is sooo gutted! Hi guys I have had final decision for I & Go regarding the DS games my son lost on hols. They have to 'regrettably' inform me that they cannot make a payout because as stated in section 12 of their terms and conditions loss and theft of an item must be notified to the police within 24 hours and we haven't got a police report reference!! Anyone got any other suggestions or should I just give up and go and claim from my house insurance? thanks!:rolleyes:Don't lead me into temptation I can find it myself! DFW LBM 03/11/080

I've had Insure and Go trying to wriggle out of paying out too.
They are refusing to pay out for my hand luggage bag and contents which was stolen from a private bus while I was on holiday on the pretext that the bag wasn't in my posession at all times (it was on the parcel shelf above my seat
)
They're such a bunch of thieves!!

Took Platinum insurance for worldwide for myself and wife Flight fromBrazil arrived late in Amsterdam,missed the flight from there to Birminghamand had to pay over 600.00 euros for my wife and I to get home as KLM would not allow a change of flight.
Had no option but yo buy the tickets as needed to get home urgently. The guy at KLM asked if I had insurance and I said yes a Platinum one,he said well you will get it refunded. Called insure and go and guess what? not covered oh no we do not cover you for that. What a waste of space and money a complete rip off, well the policy is not at all clear on this and is obiously designed to be like that. This company should be stopped from trading they are typical of many Briish Insurance companies that want to take your money but never pay a claim.
I am issuing a county court summons against them even if I loose I hope the judge will comment on their lack of clarity and it gets into the papers.If it saves just one other person from losing out with them it will have been worth it. DO NOT TOUCH THEM WITH A BARGE POLL.0 -
Was the flight from Brazil AND the connecting flight Amsterdam bought from KLM?0

The flights were with KLM from Birmingham to Amsterdam and return and from msterdamto Natal Brazil with Akefly. KM said if we had been with them from Brazi they would have changed the ticket, as I told them they do not fly to Natal.0

What was the reason the flight arrived late0

The Arkefly flight arrived about an hour late in Brazil from Amsterdamwhich the Captain said was due to stiking air traffice control in the canaries and consequenly our flight back to Amsterdam was alsod elayed about an hour.0
