Hi
I have been with a debt managment company for 2 years come February in this time iv paid nearly £5 grand to my two creditors
This week the 23rd to be precise i get a default notification from BOS/halifax for credit card. re-read 40 millions times and then noticed the word "may"
Now i have contacted my DMC who seem delighted i have got this :eek: and i said im glad someone was cos i wasnt! He said to be quite confidently this is what theyve wanted for nearly a year now but BOS/halifax werent for giving this. Now what has confused me is he also told me that on my file there is a letter from BOS stating they are willing to accept the payments and this was sent to them in october so they cant understand why now they have issued the notification. Came off the fone feeling slightly better but still have images of me being flung in front of a judge although i have been told that any judge will throw this out because i have been making regular payments its not like im not paying anything.
2nd thing today come home from work and there is a letter from BOS informing me iv not made the correct payments over the past two months. Now in their statement they send me the minimum payment was around £620 and on this letter its says its £179??????? where has this figure came from? Why did i get this letter after the default notice to me it should of came first
As experienced posters on here can anyone tell me do you think this will go to court or does it usually go to debt collection agency as said my DMC say it will be passed to Debt collection agency as BOS cant be bothered dealing with the debt anymore

I will be free in less than three years with a trust deed - my only option as debt management was taking too long

hi they,
they send you the default letter to notify you and that they are registering your missed and defaulted payment,
then normally they sell your debt on to an agency who you can then set up a debt repayment plan up with you, if you ring then and ask they will normally tell you there procedures,
i was always to scared to ring!! up untill this year and finally rang and realised they on the phone are human like us!!! and most are really helpful and very kind (dont get me wrong there were a couple that made me feel like s++t!!)

A default notice means that a default will be entered on your credit records and does not involve the courts.
The figures of 620 and 179 make no sense without the full details of the debts and the original repayments

I'm in dmp with payplan and have received the same letters from hbos (sainsbury credit card and halifax credit card) exactly the same as you have - first issuing default and then the next saying behind in payments.
Be careful as sainsburys cc has started to apply interest again after stopping for a month, however halifax cc haven't. I have written to them and also phoned sainsburys advising that I am meeting the payments accepted etc...we shall see.
Also I have two loans with hfax and received a letter today detailing a loan agreement set up per the dmp payment offer - nothing to sign just showing me how many months it will take on dmp etc....
Seems hbos are doing something...not able to contact payplan as yet but will do in the new year. Will be interesting to see if others have had corresp like us.No spend days for March = 3Money to joint savings 2009 = £100.00Money to personal savings 2009 = £0.000 -
OK my first concern is you say debt management company... as in you PAY them to manage your debt? Or do you mean you have gone through one of the FREE charities like CCCS and Payplan and CAB?
Unfortunately I don't trust these alledged debt management companies - they often haven't a clue about what they are doing and they don't always pass on information to you.
Yes it IS possible that this will go to court BUT you can at least prove that you have been making regular payments to them and haven't missed any of these payments. I would ask the DMP manager to send you a FULL breakdown of what payments they have made to the creditors on your behalf over the last 2 years so at least you know what has been happening and if the bank is telling the truth or if the company that manages the debt has messed up (either in my view is likely btw...)DFW Nerd #025DFW no more! thank you for all your replies they have been helpful and reassuring
the dmc im with i can go on line and access my account and see what has been paid and when and i have to admit anytime i ask for anything or request a balance i get it within 5 working days. i was very anxious and still am about all this and at the beginning i didnt know there were free dmp plans or i would of went down this route. i have looked a payplans etc so im trying to get down the right road.
i also have recently just received a statement from the DMC detailing every payment made from day one and the total at end so i know the payments are being sent and i know BOS/halifax have been getting them as its on the statements from them.
3puppies im kind of too scared to call them yeah im a wimp as the last time i called them a man was just about shouting at me down the fone and then laughed at me :mad::mad: sometimes my debt panics me..... EVEN after 4 years or so.

Might make you feel a little at easy, one of my debts with hbos was sent to default straight away and to debt collection agency however...... they use their own in house dca (blair oliver scott I beleive) and once the debt is with them you just carry on with your agreement. The minute I received a letter frm BOS I called them and they said that hbos had passed the debt on, asked what I was paying them and then just set up an agreement with themselves...it was actually far easier and nicer than dealing with hbos.0

oh i cant iv sent the original off and the photocopy is at work
plus my scanner is goosed
it basically says iv got till 1st jan to pay £689 or something like that if i pay this amount then iv to disregard the notice.
if i dont pay this and do not respond to the letter within 14 days i think it is legal action may be taken or the debt may be passed onto a debt collection agency or they may try and take the money from my account
I showed it to my friend who said she got the same letter so it seems to be the bog standard one

its taken mine 2 years to get to this seems a lifetime but its not really
my DMC said to expect a letter from the above names DCA and to call them with the details of what the letter says.
With being with a DMC is it worthwhile giving the DCA a call and letting them know im with a DMC and that payments will be coming from them?:mad: sometimes my debt panics me..... EVEN after 4 years or so.
