I know you are and I understand that totally its fine, no I wouldnt still be expecting a replacement if it was 6 months ago etc, but the fact I was informed at the time of purchase that I wouldnt affect my rights by buying it then for xmas is spurring me on, also the fact that is is clearly brand new and unused, irrespective of the 8 week time scale I shouldnt have to contact Fujitsu they have sold me a faulty laptop.0

Did you buy the item on a credit card OP? You may have recourse through your credit card company too - but I would check that one out. Trading Standards are only there to advise you on how to progress with your claim through the legal process - they don't do it for you.

Simply because if Id wanted a laptop that had been rpaired id of bought a reconditioned one and probably saved myself a bit of money in the process but I wanted a brand new one with all parts working and that is what I intend fighting for, and yes if necessary I will go to the small claims court to settle this.0 -

Strange - I went through 12 months training to be able to cut and paste competantly with an understanding of consumer law. But thanks for your vote of confidence.;)
The consumer is enitled to a refund as the contract was made with Staples not eith Fujitsu. Armed with the information, if I was her, I would email or write to customer services explaining succinctly the problems and pointing out her rights under the law. She is not being unreasonable and since she will have to wait a further 3 weeks before her laptop will be back with her and fixed, I dont see what she has to lose do you?

We had a FS laptop repaired three times within the year(two new screens 3 motherboards and a power supply), the fourth time the motherboard failed it was outside the 12 month so I had no recourse but to buy a new one. Never again so I wish you luck with Fujitzu0
