  • direct finance have just taken almost 100 pound from my account i am on dla and incapacity benefit i cant get anything form there so called helpline im always caller no 5-6 can anyone out there help me with these sharks please my bank is now charging me 15 pound a day because of an unplanned overdraft from these vipers please please help :mad::mad::mad::(:cry:cry:

    Hi,
    My husband has recently been ripped off by this unscrupulous company.He received a call from them advising his details had been passed to them and he had definately been accepted for a loan of £3000.He made a point of asking them if it was them directly who would be supplying the loan and they advised it was,there was no admission from the woman to state they were brokers which they ARE.She also told him that an ADMIN fee would be taken from him once he had signed and returned the paperwork.The fee is actually a brokers fee.
    She asked him for his card details which he gave somewhat naively and despite what she had told him they immediately put a hold on his account for £49.99.
    He has received the paperwork which states in their T & C that unless it is signed by the applicant they cannot provide any services so he did not return said paperwork.Despite this,today the money was debited from our account.
    He has tried to call them but conveniently can never get through.This company are an absolute scam and should be avoided like the plague.
    I have called the Consumer Direct telephone enquiries:08454 04 05 06 today who have advised me to send a letter to Direct Finance Uk Ltd via recorded delivery and to keep a copy for myself.
    They advised me to address the letter to the managing director of the company and to quote in there the consumer credit act 1974 that states
    The Consumer Credit Act limits a credit broker's charges to £5 if, following an introduction to a lender, an agreement is not signed within six months. If more than that has already been paid, brokers must refund the excess on request.
    This section of the Act ensures that brokers are only entitled to a nominal fee if they are unable to obtain credit or hire facilities at a price the consumer is prepared to pay.
    I was also advised to add in the letter that I felt the company had given a verbal misrepresentation of what they do as they had failed to advise my husband they were a broker and had also advised him incoreectly about the fee.
    I would advise anyone who has been affected by these scam artists to call the number I have quoted as they were so helpful.Obviously I do not know yet if this letter will work as will be sending it on Monday but fingers crossed?The helpline that I called also told me exactly what to put in the letter and told me to call them back if I wanted to go through the letter for advice once I had written it.
    The way I see it with this company they are onto a winner anyway.If as per the consumer credit act they are allowed to hold onto the fee for 6 months before having to refund the money minus the £5 they will be making a huge amount of interest off everyone that falls for their patter on the phone before having to give the initial money back.

  • i stupidly applied to this company ,they rang me and said id been accepted for a 500 pound loan and that i should sign forms and send them back and then they would take 49.00 when they got forms back i decided not to take them up but but this morning i noticed they took the money anyway without me signing i emailed them and they rang me straight back as i threatened court action, i have to send my bank statment of today highlighting where they took the money and as long as they get it before fri they will post me a cheque out on friday as this is the only day of the week that they pay out so i should receive this cheque on sat they told me,i also told them they had fraudulantly taken the money as i had not signed anything to say they could take it, ill let you know how i get on on saturday when the postman has been.

    I've just had a similar experience with them as you,I was told I was approved for a £750 loan,like you I was so pleased.They asked for card details,I didn't have any of mine on me,but I had my hubbys card.I said this jokingly and the fella said that was ok,they weren't going to take any money but they needed a card number.
    checking the bank statements today and they have taken the £49.99 out of hubbys account,i'm furious!!!!!!!! I tried to ring them,waiting on the phone,next in the queue ..hmmmnn 20 mins later I hung up!!

    I will ring them tomorrow,but I was wondering,as they took it out of hubbys account,without his authorisation...does anyone know if i can do something about this??

    This might sound a bit 'obvious' and has probably been raised before, but these card transactions should have been put through at the company's end as a 'card/customer not present' type of transaction (i.e. the card's PIN was not used)

    I'm pretty sure that such a transaction can be disputed with the card issuer and a refund issued. If the percentage of disputed transactions reaches whatever trigger point it takes to raise the eyebrows of the payment services company being used by the company then I am pretty sure action will be taken by them.

    I spoke with Direct Finance on 26th March who told me that they only needed the card details to progress the loan application, yet the following day I found that 49.99 had been taken from the account. Having no funds in the account resulted in bank charges totalling £63.

    I called them back and they told me to forward them a letter and attach the bak statement, which I did. Having heard no reply from them I called them and eventually got through and was passed to customer services who informed me that they would return the 49.99, however in regards the bank charges that would be decided by the management.

    The return of the admin fee would be done on the Friday, and still I'm waiting (2 weeks) for the return of this fee and my bank charges.

    I have taken the matter up with the Financial Ombudsman who are now dealing with the complaint.

    Don't let this company fob you off with lies, they tell you that they will send you the admin fee back on a Friday, its all nonsense.
