  • Help re barclaycard please


    Both these accounts are my husbands. But on 10 July 2008 received a letter Barclaycard transferred account into my name.

    One of the accounts reached the stage of ccj. sort advice from c.a.b. who helped me compile the paperwork for ccj. They too were unable to speak with Barclaycard as they too got quoted data protection.

    I received a letter from the court on 25 Nov 2008 acknowledging receipt of defence- also stating claimant must contact the court within 28 days of receiving defence. This letter is on headed court paperwork with full address.

    I have received paper work re transfer of proceedings to local court and an allocation questionnaire to be completed before 02/02/2009.
    Date on paper work 15 Jan 2009 . This is two papers on plain white A 4 paper and five pages on peach A 4 plain paper.

    Contacted F.o.s. informed needed to have made an offical complaint with Barclays a ref number Phone call on 21 Nov with barclay head office
    i was a very long phone call lasting between 1 1/2 - 2 hours. She was also corresponding on another phone to northampton Barclaycard.

    I was informed that an error had been made at Barclaycard - that the accounts had been transferred to my name. Data protections was a problem as ccj paperwork in my name and account is in my husbands - she then spoke with my husband so she could access the information. My husband and I gave consent that either party could speak with Barclaycard as we wanted to resolve this as it had now escalated to a ccj.
    We had twice wrote asking for a copy of credit agreement with the £2.00 for each account . both letters confirmed received at northampton office. -we have not received any correspondence.
    We were told not to worry as they had sent in error to a third party CL Finance they would withdraw the paperwork the ccj would be stopped.

    20 Jan 2009 0800282390 unable to speak with person of nov spoke with two managers! informed me that three letters have been sent by Barclaycard

    20/01/2009 final response..
    No letters have been received at our address manager 1 unable to resend letters as the complaint has been closed.
    I asked if I could make a formal complaint in again told no as it was related to closed account
    spoke with (?his manager) who will forward the two letters 18 Dec 2008 and 20 Jan 2008 by recorded delivery. But was not able to send a copy of 27 Nov 2008 as case closed.

    That I had to contact customer service 08445560060 to see if anyone there would help resolve as the case is closed.
    Have now emailed f.o.s. for direction to take.

    Sorry looking for advice on Allocation paperwork?

    DO NOT feel helpless..it is not out of your conrol infact its just the opposite...YOU ARE TAKING BACK CONTROL!!
    You have made the most important move by signing up for the dmp...and although the next few months are going to be new territory for you...it will so be worth it in the end.

    You have made the move to deal with your debts, and your creditors know this, so are now what i call `in panic mode` as they know they are going to have to accept payments via payplan...so are making a last ditched attempt to get every penny from you.

    Yes the ballance may got up at the begining but keep making the payments you have agreed with the dmp and soon they will see you are serious about paying your debt back and they will begin to play ball.

    You may have some creditors that will keep trying to contact you and adding interest..but dont worry even if only some stop the interest you are still in a better position than you were...they cant have what you havent got...and you dmp payment is what you can afford.

    Please trust me an old time dmp`er, 3 years iv been on a dmp now and apart from having my kids its the best thing i have ever done, im in control, i have `spare` cash at the end of every month, i can take the kids out and on hoilday and not feel guilty.

    I no longer dread the phone ringing (infact i enjoy tell crediotrs where to go on the few and far between calls i now get), i dont dread the postie coming, i enjoy budgeting, and seeing my debts drop, iv cleared over 12k in 36 months (some of this was bank charges i reclaimed) and most of all enjoy life again.:T

    Always here for you if you need any more help/advice as are so many wonderful people on this board:D

  • Thanks so much for the positive response... It does seem that very few f my creditors have accepted the payment plan... but they are all having their payment each month.

    I am concerned that I have just had to rock the boat, as I had a large vet bill (poor doggy), that the vet has allowed me to pay off with £100 pmth... So I have had to reduce my payments to payplan for the next 3 months while this is paid...

    Am not sure how they will react, and definately not looking forward to the phone calls again...

    I just thought that I would mention that I was in a similar position when I realised that Nat West were owned by RBS.
    I opened a Nat West step account for my new "safe" bank account, but also have 2 debts with RBS (Tesco and Mint credit cards). However, i've had no trouble at all since I opened the account and no one has tried to take my money!:D
    As long as they retain their separate banking licenses then you should be fine. But I would monitor the situation in case that changes.
    If I was in your position, I would probably stay with my current bank. In my opinion, CCCS dont always give the best advice. They also prefer you not to ask for copies of CCA's from creditors too, so not to rock the boat.

    Anyway, like I said, this is just my opinion.;)

    I have a `proper` debit card with co-ops cashminder account..no credit checks done on this account..it is an account you have to post application of for, can fill the form in at branch but they have to post it, took about 4 weeks to set up.
    It is a visa electron and in 3 yrs havent found any one who doesnt accept the card, can use it to pay for things online and over phone which makes regular bill payments easy.

  • Finally got news from Coop - that my cashminder account has been set up today - so went into local branch and they provided me with account number and sort code so that I can fill in new direct debit forms to pay all utility bills. Also registered with their online banking tonight - had to phone them to do this but all sort within a few minutes.

    Hopefully I should receive confirmation of account and electron cards within the next few days.

    So pleased that this is all finally coming together - just got to hope creditors play ball now no doubt within the next few days the telephone will start to ring constantly to harrass me for money.

    Thanks for all your support everyone sometimes being in debt can be so lonely - but not on this forum - the support it brill keep up the good work everyone. :beer:

    Its all easy from here on in with our help, and the cashminder account is great iv had no probs with it, infact i opened an online savings account with em to!! And online banking is a godsend!

    Hi Everyone - very new to this and head is finally out of the sand, did the debt remedy on CCCS this aft and had quite a lengthy chat with a blokey there and OH and i are pretty sure that this is the road to go down, not ideal but will mean that i do not spend hour after hour, month after month juggling money and credit not only to pay credit but also to biy food and pay bills etc...

    We're very good in that mortgage and CT are totally up to date with no missed payments but everything else is just way too much now that we are seeing the effects of no overtime and bonuses, although if i'm honest even then it was a struggle.

    I'm waiting for the initial info from CCCS and they've advised that i set up new bank accounts (waiting for response on a Lloyds TSB acc as really want to retain a debit card) if not then CCCS have suggested the co-op but they only offer a Visa Electron card.

    Can anyone tell me the main difference in terms of where and when i can use an Electron compared to a Visa / Maestro debit?

    Also one of my creditors Natwest i have a loan, OD and CC with, so if i get paid at the end of Jan what happens to my loan payment on 3rd feb. My wages will go into my Natwest acc and i need them in there to pay CT, mortgage etc so how do i stop them taking my loan payment as well as they just take the payment from my acc and i figure if i try and stop it they could well just take it anyway as they have direct access to my account. Should i just let it go through and make the token £5 to the other creditors or do i try and stop it but then risk them playing silly beggars with my current acc which is very OD? I dont want them to reduce the OD so i cant use my wages for instance....

    Sorry to ramble but i cant get my head around this one ...and thank you very much for all the reassurance over the last few hours i've been sat here devouring every bit of info we can find...with a DMP we might just start to enjoy family life again:-)

    Msc if the payment doesnt go out the same day as your wages, draw the money out.
    I have the same creditor in natwest had loan,od,and cc with them, i canceled all dd straight away, and drew any money out the minute it went in, until the defaulted my account.

    I have the co-op cash minder and havent found anyone yet that doesnt accept the electron, have it on file with ebay sellers account for my extra money making, use it to pay rent, ct, online purchases, over phone purchases, shopping ect, never found a shop yet that doesnt take it.

    Natwest combinded my o/d and loan into one new account number but they were the only creditor that added all interest that would have been paid over loan period and this became my ballance...but they are the one creditor that have been fantstic, agreed to payments, phone me and my dmp company every few months to say they are still happy with payments, never made me feel bad and have been great

    You will start to enjoy family life again, my oldest 3 kids understood the mess we were in as we were very open about our debts, as i never want my kids to go through this, they have been wonderfull and understand the differnce between wanting and needing something.

    The dmp has allowed me to bring in a reward system for them where they work together to achive family treats which they pick at the start of each challange...the latest one being a trip to the bowling alley with tea at the local pub after!
    I now have the money to be able to offer them these treats which i never had before.
    Life is so much better
