I completely understand what you're saying :rolleyes: It does become a bit of an obsession doesn't it!? I am having probs with 2 of my creditors and was obsessively trying to find posts which mentioned them to see how they "might" treat me -I've realised now they seem to have as much consistency as a throw of the dice so I'm just going with the flow, so to speak
Anyway, as I've read so many times, being in debt is NOT a crime and we don't have to be intimidated by these people. Keep strong people!!!! :T

Thing is we went to them worried about debt their advice which we stupidly took was consolidate hence the 25K loan.
We have worked sooooo hard to deal with this and now they kick us in the teeth. Seriously tempted to throw in the towel and go bankrupt. If they just left us alone i know we can sort this. Basically we are over comitted for the next 12 months after which i seriously think we can tackle this debt at about £600 PCM which is nearly double what we are paying now.
Re the CCA i have it ready to take to the PO tomorrow obviously doesn't apply for the overdraft but thats the least of my worries.
Fairly sure they will be able to produce it though as i can remember the day we signed it as though it were yesterday. This debt thing has accumulated over years.

Does the loan have any ppi attached? If so, have you tried a mis-selling reclaim? Also, dont forget about reclaiming all the charges, even on the overdraft. I know that they are still on hold, but you could possibly use the hardship rules to get your case fastracked.

I'm only 18 month into my DMP. I knew nothing at the start and would have believed anything the creditors were saying to me.
Its like Toffee Penney says, you sort of get obsessed with the whole debt thing and start to research your rights. I've spent literally hours and hours searching web sites for information on cases similar to mine. Creditors think that most people dont know their true rights as a consumer and try to exploit this. Once they know you are on to them, they tend to back down. This is definately the case with some of the more aggressive DCA's.
Through requesting CCA's and reclaiming ppi and charges back, I am cutting through this debt much faster than I ever thought was possible. I will no longer be bullied by creditors!
I've gained the vast majoroty of my knowledge on this site and on the Consumer Action Group website. Without this, I dont know where I would be now. I now try to help others the same way that I was helped in the beginning of my DMP.

I find it amusing that Egg have informed my partner that they will issue her with a new credit card as they're a responsible lender, etc. Indeed, we've notified you that we're skint, starting a DMP but please garnish us with additional credit facilities.....
The Coop have demanded their cards and cheque books to be returned. First letter arrived this morning and 6 phone calls this afternoon.....wow :rolleyes:
On a serious note the wife has a "business credit card" which is up for renewal. It is purely for work (hotels, transport etc) however could this cause any problems for the DMP or hassle for her work........?

Hi, if I start a DMP for the debts in my name, will my OH find out about it? What i was thinking is that some of banks I have C/C with he also has C/C with, different accounts of course, but I am down as second card holder. Will they stop his C/C as well, because obviously he would know something was up then! We have no joint debt apart from our overdraught and mortage. Will I have to include the overdraught , as he pays the intrest on it? Any help gratefully rececived0

Am I right in thinking that if you request a CCA the account has to be placed on hold until it is supplied? i.e. no phone calls?

Morning! (afternoon even!)
Well last post of the week arrived this morning - we now have
Defaults from
- Natwest loan (waiting for SAR response)
- Egg loan (they are in default of CCA request on Monday)
- COOP (sent a very suspicious looking 'CCA' which I'll be examining closely).
- Natwest cc (sending SAR on Monday because I think there are charges on it)
MBNA (x2) need to get CCAs back to us on Monday, we have a few more CCA requests to go out (marbles, barclaycard, citi, monument). Next sent us an application form which is is in no way a valid CCA. Monument, citi & Next have indicated (though not promised) that they will accept the DMP - what the rest will do is anyone's guess, MBNA & Egg are the ones we worry about most.
We spoke to NDL (who were excellent) about the natwest current account charges situation & helped us write another complaint letter. This morning we got a letter from natwest saying that they had refunded the charges! Now we need to get the account closed before they find some other excuse to charge us for something.
This week Barclay Card have been calling constantly (first one today was at 7:55, last one last nght was at 8:45) Aegis (who we are still ignoring until MBNA send a letter of assignment - which they won't because it hasn't been sold on) still call regularly too. We haven't taken a single call from anyone on either mobile or home 'phones & that makes it significantly less stressful than it could be. One thing NDL reiterated to us was that there is never a reason to talk to a creditor on the phone - keep everything in writing.

Hi everyone, I have posted on a different thread but thought I should move onto this as there are quite a few ppl starting a DMP the same time as me.
I have been in contact with Payplan and had my 2nd call about I&E and now just waiting on what they think would be best for my situation. I think DMP as I have done a CCCS debt remedy and they said both IVA and DMP but my thoughts are a DMP seems more flexible to me and family in these times of uncertainity. I have already opened a new bank account (HALIFAX) to move away from my creditors that I bank with (NATWEST & BARCLAYS), I have cancelled all priority DD and reset them up with new bank.
I was then advised not to pay creditors the full amount this month just a token payment, but I am not sure whether I just pay them via internet banking with a letter, as this will reach them in time for the payment date and wait for there response. Or send a token payment in the post with a letter but this will not meet the payment dates.
Secondly I have a loan with Natwest that is due out on the 1st of april same day as wages will go in (last time then into halifax), If I ask them to reduce this months payment and they dont they will send me into O/draft will this matter as it will be more now than when I spoke to payplan during the week.
And a loan with Barclays, I can get my wages out of there before loan is due out, and offer reduce payment but if they dont accept and take full amount my o/draft is only 200.00 and payment is 332.38 so I will incur loads of charges and high interest.....really not sure what to do.
I am tempted to pay loans this month to keep them out of o/drafts until payplan talk to them, and just reduce payment on c/cards then struggle this month until plan kicks in?? Can anyone give my their advice or opinion??0 -
Has anyone else had problems with the HSBC???
Just in my first month of DMP with the CCCS. HSBC is one of my creditors - I have a current account in (agreed) overdraft and a personal loan with them. As per CCCS advice I've moved to another bank for my wages, and sent my token payment to them for this month along with CCCS notice of entering into a DMP. (Incidentally, sent it 16/3/9 by recorded delivery and post office Track & Trace shows it still hasn't been delivered ... :mad: :mad: ).
Anyway, since my payment for the loan didn't come out this month, HSBC have been ringing each and every day asking if I can make a payment. Every time it's a different person, calling from an overseas call centre, which makes things worse as I really can't understand them, and their inability to change from their obvious script doesn't help things either.
I've explained that I can't pay anymore as this would be coming out of my personal budget drawn up by CCCS, plus that extra payment to HSBC would be unfair to my other creditors. They tried to get me to set up a standing order from my new bank account and 'go outside' my DMP, to save CCCS having to pay them (how thoughtful!!!!!! :rotfl: ). They also asked if I had any way of getting extra money such as from friends or relatives!!!
Anyway, having had a number of these calls going over the same thing, I actually thought, what the hell, let's let him go through his script. It turns out they want another department (I pushed for their name but not given) who will "help me with my financial problems" possibly by putting my overdraft and loan together. Is this just a way of getting me to increase my loan??? Also, they claim that their service will work alongside the CCCS DMP. I've said this mystery dept can call me on Monday evening.... What should I expect. Is it all just sales speil?
