    As long as you keep up with your mortgage repayments they cant touch you!!!

    When your fixed rate ends, you'll probably just revert to their standard variable rate. If the interest rates are still low, you'll be better off!!!

    was wondering if it is OK to request information as above. I am in the process of sending Lloyds TSB a SAR and would like to know if I need to state that I want it for cuurent account, loan account & CC account

    Oh yes, I understand that Cocker, that's the frustrating thing. They're getting £50 odd a month off me in extra interest, and they're quibbling over a few quid...

    When you send an SAR request they have to send everything they have that relates to you, which means if you have 3 different accounts they need to send the information from all of those. I would send the letter with the 3 accounts listed as you have, that way there can be no excuse for them leaving anything out.

    Thanks for that info, I was just going to send a CCA request separately for my RBS and Mint cards(aslo RBS) so does that mean one request for both accounts will do?
    Also does the SAR request include a copy of the CCA, if so I might do that instead and then I get the list of charges too, so I can claim those back.

    They do the same as payplan are doing for me now...the only different is the crediotrs are overly happy as are getting more money each month.

    as it stands at the moment we can afford our debts, around £40k,but my partner is due to go on maternity leave in August, which will impact our income dramatically, hence why we want to set up a DMP,my way of thinking is, start it around May, that gives the creditors 3 months to give us grief, then hopefully after that they will settle down in time for us to not worry about calling/phoning and enjoy the birth of our first child
    We are toying with the idea of eurodebt as it is one our financial advisor works with and he is really good,(I am not that naive to know he will be getting a cut of whatever we pay)he went over and above what he needed to do to sort our mortgage a few years ago. And also with the eurodebt mob, they give u a few months of not paying anything to creditors (we will pay them a fee to set it all up of course-but no where near as much as what we pay off on loans a month) so that will enable us to get much needed baby stuff-I know everyone says don’t go with the fee paying company’s, but with my reasoning behind things I am hoping this will be the best bet (at least for the time being) and also the figure we pay of a month will be low so we can save cash for F & F settlement figures(plus I normally receive a lump sum of cash at end of year so that would help even more so)

  • Hi there - new here, apologies for length this post is going to be, but I'm after some advice in trying to help my dad out of a hole:
    We found out just before Christmas that my father had run up quite significant debt – a £120k mortgage from one of those punitive double-digit rate companies, which he had been drawing down on over a number of years and latterly servicing with credit card debt, to the extent he now owes c£30k (roughly even over Capital One, MBNA and Barclaycard)

    Last month, we have managed to get him a proper mortgage with a decent rate, slashing the payment down, but he still has nothing left after utility/insurance/oil etc; I still have to contribute food and some living costs, but at least it’s better than it was and manageable for me for the medium term, although I have no savings left myself now.

    I have also been corresponding and conversing with the credit card companies, and have managed to get the MBNA and Capital One accounts frozen. [Barclaycard are insisting it needs to be done through a debt management company, but I have been trying both the CCCS and CAB almost daily but can’t get through and am loath to pay as we need all the funds we can to help. At one point they told me they had frozen the account on the phone, but when they next bill came in, they hadn’t in reality. I have also recently sent in an extract from CCCS advice on-line re the self-administration option, in the hope that will spur them into action.]. We continue to make token £5 payments each month, but it is not enough to prevent default and debt being passed on.

    I can spare c£200/month to contribute to a payment plan, but at that rate it would take over 12 years to pay off the debt, and cannot commit to that length of time. Ideally what I would like is to make a lump sum payment to clear the debt now, and be done with it all.

    I originally offered a total of £7,500 (26% of debt) – refused by all – but lower loan rates now mean for £205 I could get a 5yr loan of £10k (35% of total debt) so I recently offered that as a lump sum (or said they could take the £200/month themselves for 5 years and get £12k, 42% of the debt, but over a longer period). I have yet to hear back.

    MBNA and Capital One have alluded to the fact that they will accept short payment as settlement, but won’t say at what level. MBNA suggested 95% to preserve his rating, but that is out of the question (besides, I am not worried about my dad’s rating – if he never gets credit again, it would be a good thing). I think that realistically if I remortgaged I could get raise £20k (70% of debt), but I would need acceptance first before I began proceedings, and a couple of months to complete (assuming I could get the extra– I could afford the extra payments, but in current climate possibly not the funds)

    Don’t want to go down the bankruptcy route, and my mum (miraculously) is unaware of this all and it would send her over the edge if she found out. Surely this would net them more than if they sold the debt onto a third party, be quicker than a drawn out payment plan, and help me solve the problem quickly – a win, win situation all round?

    From rather a long post, in summary I would like advice as to how I can:
    a) get Barclaycard to freeze the account, and
    b) negotiate a lump sum short settlement, so that I know what total I’m dealing with and go about obtaining the funds
    I really don't want to shell out any more money for a debt company, as that could be going towards clearing the debt itself.
    In particular I have seen posts (which I now cannot find) from a lady actually working for the CCCS, and also someone who managed to get a 30% short settlement with MBNA, so any advice from those people (or ANYBODY really!!) would be most, most welcome

    thanks for that, does anyone know if I should tell Payplan that I am going to send SAR & also if Lloyds will take a dim view of me requesting SAR

    Hi Don't think it's necessary to inform payplan, and It doesn't really matter if Lloyds take a dim view or not, you are perfectly entitled to see ay information they hold on you.

    You seem to be a real pickle, and hopefully this forum will be able to provide you with some help. Just to say, I know the CCCS number is often busy and you are put in a queue but it is an 0800 free number and you'll be so glad you did hang on to speak to them as they are very very good and non-judgemental - they don't focus on how you got in the situation, just look at the solution. Also, how about trying their Debt Remedy online which is on their website? Have details of your finances in front of you when you do the remedy, which will take approx 20 minutes, and it will give you immediate help. You can opt out of the site at any time - they only take your details at the end if you decide to find out more about the options.
