NIce threatening letter recieved from MBNA regarding my loan (£12,000)
they say ive been avoiding them, not taking their phone calls and not responding to their letters.
Interesting in that they have not contacted me for 2 months since I sent them the token payment, and they called on Saturday morning when I was in bed, and then later when I was driving.

That's what we've had from Egg - in our case we've sent them multiple letters by registered post (that they've signed for) & informed them that we will not discuss the matter over the 'phone. Morons.0 -

Thanks for the number. I had my assessment with payplan yesterday and cant speak highly enough of them. The lady i spoke to was lovely. I have my first payment set up for 9th April. She has all my details so im now going to send off a letter to all my creditors with my payplan reference no and then wait for the authority to come in post from payplan and get that signed and sent back and my standing order set up at bank. I am able to use my first trust bank account as i am continuing to pay the loan in there as it cant go on dmp as my mothers guarantor. Its a full current account and i have no overdraft on it so can use it for my other dds and my standing order to payplan. So as far as i can see its all systems go. It will be scarey tho these next few wks seeing what the creditors do, but its my only way out.
Apparently i had to have £200 a month available surplus in order for them to accept me for dmp though i always thought it was 100, i am more thna happy with 200 though, although wont have luxurious life il have all that i need. Payplan told me im living under the government guidelines for what people are allowed to live on so they cant say im not paying enough i hope. Im happy with the fact that it wont be forever and im finally doing somethin about my debts rather than burying my head in the sand.0 -

You are doing the right thing definately, it is a weight off your mind when you speak to the debt management company isnt it?
Hope someone can help me, before I opted to go with CCCS, myself and hubby went to Citizens Advice who gave advice only and we sent out our own letters and offers, unfortunately we discovered that Citz Advice did not give us all the correct info, as they didnt tell us to change bank accounts and to include our o/draft and next account. I found this out myself through this great forum and then rang CCCS who have been fab.
Needless to say none of the creditors had responded to our letters anyway until today when Nationwide (those lovely understanding folk that they are)
wrote and said they rejected my husbands offer and if he does not ring to discuss otions they will serve him with a default and pass on to debt recovery who will consider legal proceedings.
Also the next ot arrive was a default letter for hubby for his Tesco card, no mention of our letter.
And thirdly a normal monthly statement from me form Barclaycard where they have added interest and also no mention of our correspondence.
What do I do? As our DMP with CCCS doesnt begin until 1st May. I have sent off token pyts and letters today.Also I had a message on phone from RMA asking me to ring very urgently. Do we ring these people and respond to the letters and calls? or just ignore it? I dont know what to do for best. Is this default a bad thing now? Do I have to inform CCCS that this came?
Hope someone can help as I am feeling very worried today.

You may find that a few creditors will add interest at the beginning of the DMP or even at some point along the way, also some my default you but it doesn't go further.
The default will stay on your file for 6 years.0 -
I had my first telephone chat with Payplan today, they are going to get back to me in 3 or 4 days with options, as Louise82 the lady I spoke to was very reassuring and understanding, I have typed up letters ready to send to the creditors offering a token payment, hope they accept it, still waiting for new account from Co-op, been waiting almost a week, the days are dragging now, I just want to get on with it.

Hi Cheesypuff,
Firstly, just try to relax & don't worry about their threats, continue sending the token payments. If you phone creditors most of the time they'll end up convincing you they can do all sorts of things & get you to agree to a bigger monthly payment.
I had problems with Nationwide as well. The first thing they'll do is put it in the hands of their in-house collectors & I found them much better to deal with than the bank itself. They did sell my debt on eventually to Fredricksons who I've had no problems with at all, they accepted the DMP immediately & I've heard nothing since.
Some people worry about Defaults as it obviously affects your credit rating but I don't care myself. The DMP affects your credit rating & they all tell you that so I don't see why defaults should worry anyone, they are only there for 6 years regardless of whether the debt is paid in full or not.:j DMP mutual support thread member - 135:j0 -

These letters are not as scary as they look in our experience - getting a default is standard and the earlier you get them for your accounts the better as they drop off your record in 6 years I think. Passing your debt on to debt recovery can sometimes be a good thing as they can be more likely to accept your offer. We got lots of letters saying that they MAY take legal action... its just scare tactics. We also got offers refused first time out that were accepted later. Also no mention of receiving your correspondence is not surprising. Let the CCCS know about the nasty letters and let them deal with it for you.
We did keep responding personally to our creditors letters and calls - but its up to you if you want to, or you can let the CCCS take care of it all on your behalf. If creditors asked for a call then I'd call - tell them I was with PayPlan (CCCS in your case) give them my number, ask if they had received our correspondence and if they had accepted my offer. Usually they would say they had no record of any letters (liars!) and ask for payment, and I'd say I'd re send everything including the SOA by post and put the phone down. If they got in the slightest bit nasty or started to pressure me for more money I would put the phone down. In every letter I wrote I asked for no further phone contact, and eventually this seemed to sink in. If you feel worried about anything speak to the CCCS - they should be able to put your mind at rest.
Also if I really did not feel like taking a call I'd just give the wrong date of birth or postcode on the security check - they would instantly hang up (if I hung up they would just call back). I don't k know if you can get in trouble for that - but a few of them never called me on my mobile again (I don't want to talk about my debts when I'm in Tesco's or at work! horrible companies).0 -
I got told that it's likely most will default and that it actually helps and that they are more likely to accept the reduced payment!
This seems to be true of most but not all! But don't worry about it! also the sooner they default the better apparently as it's on for 6 years so the sooner that 6 years starts the sooner it's over! (I hope i'm right in telling you that, that's how i understand it from posts on here!)
i never rang these people back, i just sent any letters to payplan and if i was worried or had a query i just rang them up and they were always very helpful!
