my seller thinks she is covered by paypal

my seller thinks she is covered by paypal because she has 100% feedback and 30 positive. Just had an email from her saying she knows PAYPAL will rule in her favour because they can see from this she is a serious buyer /seller.

Just one little point she has overlooked, I bought off her an AV-USB cable listed inc original Pinnacle Studio Quickstart software. She sent me the cable and a blank DVD with instructions on where to download the software from, not even the original software but another for which I'd have to pay out another 30 quid.

    I reckon your seller could be right, PayPal are a strange breed and will probably rule in their favour, so I wouldn't get too smug just yet.

    totally agree but I'm sure they'll look at my 250+ postive feedback and rule in my favour :p

    silly moo emailed me directly (I always make sure i email via ebay) but she has done nothing to reply to the paypal dispute I opened on the 9th.

    Paypal do not consider feedback scores when making judgements - it proves very little these days - the generally just look at whether it was sent tracked, confirmed addresses etc.

    In the case of Not as Described, it's usual for them to ask the buyer to send it back recorded/special delivery, at their own expense and refund upon its return.

    Every so often though, a wildcard is drawn and all bets are off!

    in one of her emails she'd actually said she sent a copy of the software i.e. the DVD, when I meantioned counterfeit and against the law she changed her story to blank DVD. I've filed my paypal dispute as both goods not as described and counterfeit goods, no way I'm sending the goods back at my expense.

    The fact she has replied to my emails but not to the paypal dispute is a bit weird, won't that count against her?
