Sold item, sent recorded yet Paypal ruled against me!

I sold a dvd boxset last month, buyer took an age to pay but I did send it recorded as soon as she sent her payment.

Received feedback saying thanks, perfect etc and a few days later, got an email from paypal to say the buyers bank has reversed the transaction!

I have emailed the buyer multiple times but she has not replied. Unfortunately, the recorded delivery number is coming up as not available yet which either means the postman signed for it or they didn't complete the paperwork.

Paypal have now ruled against me and taken the money out of my account to the tune of £24.

I am not taking this laying down and have requested the buyers details via Ebay so I can ring her. Nothing arrived in my inbox yet though.

Would it be worth me sending her a letter to her home address, stating I will take her to the small claims court?

The obvious problem here is that once again recorded is not worth the extra money you paid for it, all that you have is proof of posting, no proof of delivery, so it is still her word against yours. Feedback counts for nothing.

  • i know recorded is mostly worthless but I do think it puts off the shady buyers from claiming it never arrived, although in my case, obviously not!

I know I can claim from Royal Mail but it is bugging me that she is going to get away with it scott free :(

Unless the Recorded Delivery information turns up on Royal Mail's website I think you're screwed. You need to contact Royal Mail customer service right now and ask them to find out what happened to the signature, and even whether it was signed for in the first place, but if they have no records then there is nothing that you can do other than claim it as a lost item...you'll still get your money back.

Threatening court is pointless as without proof of delivery you will lose, and be out of pocket for court fees too.

  • Sound advice Zen.

I know I would be out of pocket for he court fees but the threat of it might scare her into repaying. I know I wouldn't like to be threatened by a court case for a dvd boxset!

the other thing is, doesn't the buyer have to complete a form saying they never received it? if so, what if she just throws it in the bin, do I still get paid from Royal mail?

Regardless of the compensation for loss - the fact that the package wasn't signed for entitles you to compensation (perhaps stamps). Soolin is the supremo on this one :D
    My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j
  • play them at their own game. now apologise for them not having received it, and say you will send out another one. this time tho, just send a similar size box with nothing in it.

    and then make 2 claims...

If she didn't sign for it then she would know that you have no case, but you never know :)

You know, I'd claim from Royal Mail anyway, as well as claiming from Paypal...never know your luck..could be refunded twice :p I know someone who did that :rotfl:

Thats crazy. Surely if the buyer has left feedback saying thanks etc they've admitted to recieving it ??

    appeal the decision with paypal.
There is an appeal form on the paypal website
    i found this and it may help;

When a chargeback happens, the amount of the chargeback is taken from PayPal. In turn, we place a temporary hold on the transaction in your PayPal account. This will show as a deduction in your PayPal account balance.

If you are covered by Seller Protection we will remove the temporary hold and return the money to you. If not, we will reverse the transaction from your account.

If we have enough information we may be able to dispute the chargeback directly with the card issuer. The dispute process can take up to 75 calendar days depending on the credit card issuer. In the meantime, the payment will show as reversed in your account. If we win the dispute we will notify you and your PayPal account will be reimbursed.

To help you better understand chargebacks and avoid situations that might lead to them, you can visit the Security Centre’. You can learn more on how to respond to a chargeback by reviewing the step-by-step tutorial in the Resolution Centre.
You could file a claim with royal mail and get them to investigate the loss if you have no luck with paypal
