Recording a phone call
Please can you help, i work for a small company where the Boss and his son share the office with me, an employee rung up with a wage query and as I did the hols and pay I tried to sort out the problem which I was sorting out then the boss took the phone of my and got into an argument with employee, later on, the employee called into the office and said he had recorded the conversation, it only hit me after that I was on the phone and he must have been recording me, is this allowed has I feel very violated now and is this legal? as it seems to me its as bad as bugging a room, Am i overreacting is there anything I can do about it can we get it erased as the bloke is really creapy

as far as i'm aware if you are going to record somebody you have to make them aware first of all that the call is being recorded (this is why when you call a call centre they always say the call may be recorded), i know how you feel a few years ago i found out that a customer had recorded my conversation with him without advising me, i had to get my manager involved who then had to deal with it and advise the customer what he had done was illegalThe only thing worse than being talked about is not being talked about - Oscar Wilde:beer:

Is there any chance the employee is bluffing. It is illegal to record a call is the other party does not know.xx rip dad... we had our ups and downs but we’re always be family xx0

i agree that you must declare to the other party that this call is recorded and they must agree to that before any dialogue may take place0

Firstly, I would speak to the person concerned and advised them that what they have done is illegal and you want them to destroy the recording immediately, ideally in your presence. If they refuse you could report the matter to you boss as a grieveance against the employee and as he also recorded him he may be on your side. Not spoke to him about it he didnt seem to bother when he knew, he would probably think iam overreacting but he would probably sort it out, i dont want to make a situation worse with the boss and employee.

People on here are saying that making a recording of a phone call without making the other party aware is illegal. I do not know if this is true or not. I know that if the recording was made without all parties being aware then the recording cannot be used as evidence but, whether or not the initial recording is illegal or not needs clarification.Something Really Interesting0

You are not allowed to record a call, if neither party is aware the call is being recorded (phone tapping for example).
If one party is aware the call is being recorded, they do not need to inform the other party if it for their own use.
If you intend to share the recorded call with a third party and have not informed the other participant, you could be on the receiving end of a civil prosecution.0
