Advice please re ticket for no vehicle license at a railway station

as per the title I have a query re a ticket I received at a railway station. I received a fixed penalty notice for not have a valid tax disc.

I did have a valid tax disc, it was stupidly left in the glove locker due to being rushed for work. The old tax disc was still on the windscreen.

Ist question - can someone tell me the wording of byelaw 14 section 129 that gives the railway company the right to fine me for no licence. I can see mention of obstructions only.

2nd question - my ticket only states that I do not have a valid tax disc. I can prove that I do. The ticket does not state a valid tax disc on display. Even though mine was (although not on the left side of the widscreen.

    i cant see why you should be fined for not having a licence when you clearly do and canprove it. Simple as. So i would fight it.

    I think i would tell them the truth as to why it wasnt put into the holder and see how it goes.

    It's not the railway company that have issued the ticket, it's British Transport Police.
  • Tell em to do one! Unless they had photographic evidence that at the time of the offence you didn't have a valid disc - the BTP wasn't to know it was in your glove box...

    Ps, the offence if pulled by the usual Police is 'Failure to display', not not having a valid a tax disc.

    I did have a valid tax disc, it was loose on the dashboard. The old tax disc was still on the windscreen however, the new one was visible. (My car is a convertible and I have not yet fixed a tamper proof tax disc holder).

    yeah, the offence is normally failure to display, why would the btp be different?

    nope its not a wind up.....

    i understand it should have been failure to display, wouldn't they have got in touch with the DVLA to see if it did have road tax?

    I don't think it actually matters whether you have tax or not as the offence is "failure to display"

    Used to be £20 fine for failure to display. Would have thought that ticket could be disputed if incorrect.
