Hi everyone -
Sorry to bring this one up again.
Still not got my cd - seller did email over a week ok to say she's send a cheque for the p&p, and I've not received it nor a reply to my last email to her.
I want to do a charge back but don't know how. The money came out of my bank account and not from a credit card.

I sent out the wrong items a few weeks ago and was so embarassed! Luckily the two buyers involved were fantastic and patient and sent it on to each other, I refunded postage costs and a little on top, everyone was happy (well I was out of pocket but still!)"I did then, what I knew then. Instead of sending a cheque why do they not do a partial refund through paypal? Much easier. I've made the same mistake and it took a bit of effort sorting it out. May be time to open up a dispute just to nudge them along.0 -
I'd be inclined to go for dispute via ebay first before doing chargback. If the feeback for the seller is good then it's likly to be an honest mistake.0

No, never go through ebay if you paid by paypal. A paypal chargeback is free, an ebay claim has an admin fee of £15.
It doesn't matter how 'honest' a seller is, this one has had plenty of time to rectify the situation.
Do remember though that a paypal chargeback must be started within 45 days of payment, don't let that deadline get too close before acting.

Do they? - never charged me. As far as I know they just send the seller/buyer an email to remind them. Went to dispute recently - no fees charged yet - item purchased before christmas and never turned up. Seller not answering emails. So requested dispute and within a week the item turned up. (yes, it may have been delayed in the post - either way it arrived).
As both a seller and a buyer, I can see both points of view, things can genuinely go wrong. And paypal always sides with the buyer unless there is proof of postage (by that I mean it has to go recorded)

I think anyway, and Jaffa might be able to confirm this, that even if you do start a dispute through ebay and paid by paypal it will automatically default to paypal anyway to save you the fees?
A reminder though is different and is just a polite note, to recover the payment a full paypal chargeback *must* be done.

OK, just checked ebay account, and the bank account attached to it, and the paypal account and there are no records of admin charges (no-records of unaccountable charges) around (two months) after any of the disputes I've raised - about four in six years (two recently).
Are we talking about the same thing?0 -

thanks for the feedback. Well I attempted to open the dispute initially with Ebay, but it went to a page which said:
"Open a Dispute: Continue to PayPal
Transaction: The Ataris - So Long Astoria.New. (CD 2003) (#4805969982) sold by laurz_0610 on 13-Dec-2005.
eBay works closely with PayPal to help buyers resolve their transaction problems quickly and efficiently. Because you paid with PayPal, reporting your problem to PayPal is the best way to reach a resolution. PayPal can provide you equal or better buyer protection in a timely manner through a clear and simple process.
You will now be taken to the PayPal site to log in to your PayPal account. After you log in, you can continue reporting your dispute and file a buyer protection claim. After you file a claim, and throughout the time that PayPal is working to resolve your dispute, your claim status will be available on the PayPal site.
If you feel that you have reached this page in error and did not use PayPal for this transaction, please continue with eBay's Item Not Received process."
Then it takes you straight to login to your paypal account. So I have opened the dispute with paypal now.
I understand that this is more than likely a simple mistake on the part of the seller, but the last time I heard from her was 13/1/06 - not had any response to my email sent the same day since nor had a cheque for the postage either. I sell items on ebay too - just stuff I have lying around the house that I won't need or use anymore and I know that if I had sent the wrong item out in error or there was a mix up I would be checking my emails more often that one a week (as she has been doing) or more often than once every 9 days to sort it out! I would also be responding quickly and doing my best to sort everything out swiftly.
She's just leaving me and the other buyer to sort it out between us - without any intention of reimbursing the p&p it seems. I've been in touch with the other buyer and he is getting the same from the seller - she's not responding to emails (the quickest she has been in responding is a week!) and she's not sent him a cheque for p&p. He asked for the same p&p that she charged him in his auction and she's refused to pay that much saying it doesn't cost that much to send it on! But he has not heard from her since 13/1 either.
Also, he opened a dispute with paypal at the end of December - and paypal came down on his side, but he was told he couldn't get any money back because she has no money in her account?????????
Anyway. I've left her a negative now, factual and precise. I expect I'll get one in return but I'm a big girl now and think I can handle it!
