Are Next Directory legally allowed to open a credit account without my permission?

its ridiculous that such a well known company resorts to such underhand tactics! i am sure the company has lost good customers or atleast customers have been put off buying because of such decietful ways.

Next are a pain to order from online. I would buy a lot more from them if I could just order and pay there and then and thats the end of it. Why cant they have that option? Lots of people dont want credit accounts. I last ordered at least a couple of years ago and they still send me catalogues along with a bill for £3.50 which i just ignore. As far as I am concerned I didnt ask for the catalogue so why should I pay for it. I have to admit they havent sent reminders or anything.
Hi you only actually pay for your directory if you order from it, the reason your haven't paid for it is you havent ordered anything(lists this in terms and conditions) if you dont ever order from directory youll never be charged.
I get the directory all the time however are never charged as over on line and in store so therefore it i free if you like.
I quite like next and means i get alook at things before they come into store and get VIP sale things too.0 -

I found the posts fascinating. Next are doing nothing wrong. Blaming Next because you can't be bothered to read the specifics of your order is naive at best. If you are ordering goods and services for which you do not pay for at the point of ordering, you are deemed to have a credit account. All orders/ transaction via the internet are governed by Distance Selling legislation, which allows for a cooling off period. Distance selling covers credit orders and orders paid for at the time of order. Be informed by copying and pasting the government link below in a new browser.

i suggest you actually do a mock shop with next online.
there is actally no clear option to pay with a card.
on the checkout page it asks you to register as most online shops do. then you create a password . then the options make it appear as though you are opting for a delivery which is going to be charged. fair enough. you are then taken to the next page which states that delivery date.
it does not ask for payment details as you would expect but just says you do not have to pay for the order now till delivery---thats when alarm bells start to go off as no payment details have been actually asked for.
however it does not say that a credit account will be opened for you.in fact you do not ask for it AT ALL and is automatically opened for you.
yes informed shopping would be good but they need to [EMAIL="BL@@@y"]BL@@@y[/EMAIL] inform in the first place.0 -
I agree with cocktail, got caught this way myself and I have been internet shopping for years. It is so different from the way EVERY other reputable company works that you don't expect it; I won't be shopping at next online ever again.
Also, you can't have it delivered to store until you have had one order delivered to home address apparently, how stupid is that. ANd they are always trying to get you to pay for their catalogue. Next are very arrogant.0 -

I was asked to enter a competition in our local Next store. Which I did. The next thing I knew was a catalogue turned up and an account had been opened with a credit limit.
I rang and complained.
They were very apologetic and said they would close the credit account and remove the search from the credit file. They also asked which store had done this without my consent and said they would be investigating why this had happened.
More than likely the member of staff got commission for opening accounts for Customers. I was not impressed at all.I want to be credit card and loan free by Christmas 20100 -
Yes, same thing with me. Next are extremely shoddy. They lost my online custom as soon as they opened (and I then closed) my account. They don't make it at all clear that that's what they are doing, though it probably is in their T&Cs.
Shameful that such a large organisation can act 10 times worse than Dell-boy.0 -
Obviously updated their conditions to..."WILL be opened"

its always been stated in the T&C's. if you click on you accept the T&C's without actually reading them you have no one to blame but yourself.
As mentioned earlier - if you don't pay when you order it must be a credit account. You don't have to complete the order once you realise - you choose to.
This is why you should always read the T&C's.0
