Got up on saturday to a court letter from Paragon i'm so angry. They want to repossed my property
The loan is in its final year i owe £2600. My arrears have gone from £285 to £700+ with 5 charges for agents that apparently have visited my address (£65 a time) and they have never visited. They have also stated they sent me a defalt notice by recorded delivery..never received (surely i would have had to signed?)
I have been a little unrealiable but at the end of Oct i wrote and asked them to reinstate my Direct debit for £226 and i would pay an additional £100 till the arrears were cleared. They never responded. The 31st October i got a notice of intention to default and i questioned a charge for an agent that never visited my address in September..they never responded. on the 3rd of November i wrote and said that as i hadn't heard from them i assumed they were ok with the agreement and I would begin paying...they never responded...
So I waited to see if my Direct Debit would go out on the 25th - it didn't so i left it a bit longer and paid the £226 monthly payment on the 8th december and the additional £100 the following week and i have the £326 all ready to go this week
I'm so annoyed i haven't slept all weekend :mad:
Does anyone know what happens? will i get a CCJ? if i get that i wont get this new job as you aren't allowed them in my line of work

Hey dtdt,
I know only a very little about CCJ's but I would suggest that you have good grounds for defence in this situation. Yes you would have had to sign for a recorded delivery letter, you can ask for proof of agents visiting as you have not seen any and you have been making token payments towards the arrears. As you can deminstrate that you have talked to them during this time (ie when you spoke about the rate cut) they will struggle to make a case against you in court.
Best advice would be to make an appointment with CAB to prepare your defence asap.Debt £5600 all 0%0 -

Good News! i rang paragon and started asking questions:
1) Who signed for the default notice - it wasn't signed for - erm is that a false claim on your particulars?
2) i've been trying to contact you to arrange payments for 2 months can you confirm you recieved my letters - Oh you have - so why have you not accepted?
3) Can you confirm my payments over the last 4 weeks - So again your particulars aren't correct
Actually she was really nice, she is sending me the report for the Agent - who descibed my house as proof he visited and i quote (a well kept house) should make interesting reading as there is not comment of the unusal shape..
Still out come is that the hearing has been cancelled, they have accepted my payment arrangement and some of the charges have come off :T

Sorry not 'checked' in for a bit - CONGRATS on the job!! :T
And well done for sticking up for yourself to Paragon. I hate that attitude with big firms - they probably scare a lot of people into a lot of things, its only if you know your rights and are comfortable in speaking up that the small folk get heard!!!
Make sure to ask for everything she said in your conversation to be sent in writing - just to cover yourself!! (as you can probably tell - I don't trust many people! lol!! :rolleyes:)

i'm going to wait for the report and complain i think - £65 for a bloke to prentend he came to my house hmpf!
Now i'm on a more positive note i'll post properly!- Another NSD yesterday - thats 8 now well on track for my 10 for December :T
- Didn't manage my shopping budget but have enough for 2 weeks £15 a week aint to bad and i did stock up
- Paid another £12.91 to Paragon :mad: quicker they are off my signature the better
- Mortgage went down again :j over paying over £300 a month so arrears should be clear by March
- Managed to spend £30 on my dinner on saturday no more, no less and went home rather than go on and spend money i didn't want to
Targets this week:- 2NSD's (xmas and boxing day *LOL* or is that cheating!)
- To buy no more food
- Pay Mortgage and Paragon Rotters
- Pay some off my Electricity bill
- Enjoy xmas as much a possible
