i would always make the claim but i also state that buyers can have recorded, special or insured delivery if they like and if they choose standard mail i wont refund them ill only pass on the compensation from the royal mail coz its not my fault is it if they only choose normal mail- if i buy something i always pay extra for recorded.
If you offer PayPal the buyer can do a chargeback regardless of the postal method used. If I buy something using PayPal I would never take up the option for recorded delivery because it costs more for me and I can get my money back if needed either way.

This may be the case but PayPal T + Cs overrule this and it is up to the seller to make the claim (unless the buyer is happy to do it).

I can see no mention of this in Paypals T & C's, can you post a link to this? The only options i can see are to start a Paypal charge back. I am talking about making a claim against Royal Mail which is nothing to do with Paypal.
if you only paid for noraml post- the royal mail will only compensate in a book of first class stamps.

You are insured up to £30 for normal delivery, the stamps offer is extra ie compensation.
Also Royal Mail do not consider something lost until at least 15 working days have passed and most people would expect a refund before this.

What a buyer wants and what is reasonable are two different things. Some people run EBay as a business and it is not reasonable to refund just on a buyers say so so early after a sale. If Royal Mail say allow 15 days then why can't a seller?

In my experience when I have sent things via the post that have not turned up the Royal Mail have been great and refunded the cost of the item. Once they did this with a receipt and once without. Why don't you give them a call and see what they say. They will probably just send you a claim form to return to them. They may well want a copy of the proof of postage so you need to talk to the seller and just arrange what's best. I am sure it will all work out!

I disagree, why should the seller refund? If this were a store they would not refund automatically. They would inform you to wait a reasonable amount of time and then start an investigation/claim process..

Its up to the seller to make sure of delivery Not the buyer.
Why should the buyer be out of pocket because the seller hasnt delivered.

Further, there is no onus on either buyer or seller to make the claim via Royal Mail should it come to that (check their website and it asks are you the sender or receiver.)

    My EBay t & c's always state:

"In the event of damaged/lost items, the buyer must claim compensation from Royal Mail, though I will assist as much as possible. "

I have had a PS2 break whilst in transit, i forwarded the postage slip to the buyer who initiated the claim. Royal Mail emailed me, asked for my version of events, which i provided, the buyer was then issued a full refund for the cost of a replacement PS2.

But in your situation, give it a few more days to let the Xmas/New Year backlog a chance to get delivered and if after say Saturday your parcel has not arrived, either you or the seller start the claim with Royal Mail.

Any good seller will pay the refund and claim it back off the RM.

Make of that what you will

Even if you pay for Recorded ( extra 65p )
You will only get upto £30 ( excluding the postage )

I agree, sort of! Yes it is the sellers responibility to ensure the product is delivered, but once it is in the hands of RM then it's hit or miss if it gets there. So why refund immediately? As per RMs t & c, allow 15 days for delivery if nothing then start a claim. It is up to the seller then does he issue a refund to the buyer and claim the money back from RM himself or pass on all details to buyer to sort out.

I clearly state in my t & c that it is the buyers responsibility to follow up any claims. I'm sorry but that is the way i run my auctions and have 100% feedback, i do this because i honestly don't want the hassle of going through a claim process everytime a parcel goes missing. But that is personal preference.

It's ok Ivy. I've decided what I'll do. Wait a week in case it arrives. If not request a refund. If that's refused do a chargeback. I understand the seller may not want the hassle of chasing R.M. but neither do I.

    Thanks for all the replies.

If you paid by PayPal you can start a chargeback for item not delivered and if the seller cannot provide prove of delivery PayPal will find in favour of the buyer thus it is up to the seller to claim off Royal Mail or they will be out of pocket. This will only work with PayPal.

If you ordered something off say Amazon and it got lost in the post would you expect to wait 15 WORKING days to get a refund or replacement? Plus it can take up to 3 months for the claim to be processed.
