Bought Item + Free Gift - refund given - free gift delivered

Hi,

Can someone offer me some advice!

I bought a product online whereby the main item came with quite an expensive free gift. I ordered this on Sunday and phoned up Monday morning to cancel.

The main item was canceled but my free gift was still delivered. The refund has gone back to my card and have heard nothing from the Company.

Am I legally entited to keep the free gift after a period of time if they do not connact me?

PLEASE HELP!

    I'd keep it!! Have you got paperwork stating it was free? I'm pretty sure I've had free gifts etc in the past and returned other items without issues xx
  • It was free if I purchased the main item.

    The main item was around £799 and this was free with it.

    The free gift though is worth around £195.....not like your usual free gifts!!

    I had this with Boots the chemist, bought some perfume and got an expensive free gift. I went to the store for a refund and handed back the free gift, the lovely manager told me to keep it. The free gift does not need to be legally returned when you refund an item apparently. :D
    From what she said, that goes for all stores and shops, not just Boots.

  • I don't want to give it back if i don't have to!
    Its' worth £195 and I really want to keep it.

    Is there any legal rule that anyone knows of?

    Well I would wait for them to contact you. Firstly if they want it back- its their job to arrange pick up or return postage.

    I would give it 28 days or something, if they don't do anything before then, keep it, its unlikely they will and it would be easy to fight back at them and say "you left it too long, I assumed it was mine/threw it away..etc"

    Just being nosy- what did you get?!!
