    It seems strange to me that it is still listed at £98 on their site. It takes very little to ammend a price error, and so I would expect it to have been altered by now.
    It is the holidays so they are probably all at home! :snow_grin
    Also, as far as I know, when money is debited from an account it is generally considered a contract of sale. correct me if i'm wrong?
    I'm afraid it's not. There will always be terms and conditions with automated orders which say that a contract only takes place later - and when you buy you agree to those T&Cs.

    It is only fair on an online purchase as computers can go wrong - it is not like a shop purchase where a human is involved who would be able to spot an obvious misprice or an unusual surge in purchases (ie. a really long queue at their till ;))

  • Another thing to consider is how many orders have been placed, and how much money they now have sitting in their accounts from people who have ordered. So not only have they had some descent public exposure, but they have had some free money from customers throuh bank interest.

    Surely they did an investigation into the trading medium and it's flaws before they used it. Not my problemo! hehe
  • I have just rec'd the order confirmation which according to their t&c's means its on the way and they can't cancel, dos'nt it?

    Got to disagree with you there - under the sale of goods act once payment has been accepted, then the contract is made regardless of what their t&c's are - the t&c's cannot overide the Law.

    The human arguement really doesn't stack up in many cases. If it did, then I wouldn't have had to get a refund from Tesco (under the refund and keep policy) today for a CD that had a dirty great big sticker saying £9.77 which was far more obvious than the £18.99 price that the till stacked it up at. In many cases, the human is underpaid and their only wish for the day is to go home - why should they care?

    Also, there's talk of Apple earning interest on people's money here. My credit card does not appear to have been charged yet - I'm hoping that it will be VERY soon.
